    Chapter I General provisions.

    Article 4 this Municipality shall establish a leading mechanism for carbon peak and carbon neutralization work, coordinate and promote carbon peak and carbon neutralization work, and coordinate and solve major problems of carbon peak and carbon neutralization work. 

    The municipal people's government shall scientifically formulate and organize the implementation of the city's carbon peak action plan, implement policies and measures to promote carbon neutralization, and ensure the implementation of the city's carbon peak, carbon neutralization goals and tasks. 

    The district people's government shall implement the tasks of carbon peak and carbon neutralization to ensure the realization of the goals of carbon peak and carbon neutralization in their respective administrative areas. 

    The municipal and district people's governments shall report the carbon peak and carbon neutralization work to the people's congresses or the standing committees of the people's congresses at the corresponding levels every year, and shall be subject to supervision according to law. 

    Article 5 the municipal development and reform department shall be responsible for the daily work of the leadership mechanism of carbon peak and carbon neutralization work, organize and implement the deployment arrangements of the leadership mechanism of carbon peak and carbon neutralization work, and coordinate the promotion of carbon peak and carbon neutralization related work.

    Article 6 in local legislation, policy formulation, planning and project layout, this Municipality shall comprehensively consider the targets of carbon peak and carbon neutralization, and implement the requirements for the control of carbon emissions. 

    Article 7 Units and individuals shall establish the concept of green and low-carbon development, abide by the laws and regulations on resource and energy conservation and ecological environment protection, consciously fulfill their legal obligations, and actively participate in carbon peak and carbon neutralization related activities. 

    Article 8 this city shall give full play to the supporting and leading role of scientific and technological innovation in carbon peak and carbon neutralization work, promote the innovation and progress of green and low-carbon technologies, promote the research and development of low-carbon, zero-carbon and negative-carbon cutting-edge technologies, and support the transformation and application of green and low-carbon technology achievements. 

    Article 9 people's governments at all levels and relevant units shall actively carry out publicity and education on carbon peak and carbon neutralization and the popularization of scientific knowledge, raise the green and low-carbon awareness of the whole society, and create a good social atmosphere to promote the realization of the goal of carbon peak and carbon neutralization. 

    Education departments and schools should incorporate carbon peak and carbon neutralization knowledge into the content of school education to cultivate students' green and low-carbon awareness. 

    The competent departments of civil servants shall incorporate the knowledge of carbon peak and carbon neutralization into the education and training of civil servants. 

    The news media should carry out public welfare publicity of carbon peak and carbon neutralization knowledge and supervise relevant illegal acts by public opinion. 

    Article 10 this Municipality shall strengthen communication and cooperation with Beijing, Hebei Province and other regions on carbon peak and carbon neutralization work, promote cooperation in resources and energy, promote cooperation in green and low-carbon scientific research and transformation of technological achievements, and coordinate to promote green transformation, energy conservation and carbon reduction, increase carbon sequestration and other work.

    Chapter II basic Management system. 

    Article 11 the municipal and district people's governments shall incorporate carbon peak and carbon neutralization into the plans and plans for national economic and social development. 

    The municipal department of development and reform and the ecological environment shall, in conjunction with the relevant departments, organize the preparation and implementation of the annual carbon peak and carbon neutralization work plan in accordance with the requirements of the national carbon peak and carbon neutralization work. 

    The departments of urban development and reform, industry and informatization, transportation, urban and rural housing construction, agriculture and rural areas should integrate carbon peak and carbon neutralization target tasks into energy, industrial and information technology, transportation, construction, agriculture and rural areas and other related planning. 

    Article 12 this Municipality shall implement the system of controlling the intensity and total amount of carbon emissions in accordance with the provisions of the State. 

    The municipal and district people's governments and relevant departments shall take effective measures to ensure that the targets of carbon emission intensity and total amount control are met. 

    Article 13 this Municipality shall establish and improve the statistical accounting system of carbon emissions in accordance with the provisions of the State. 

    The municipal departments of statistics, development and reform, and ecological environment shall, in accordance with their respective functions and duties, strengthen the collection, assessment and accounting of carbon emission data and the compilation of inventories. 

    Article 14 the municipal ecological and environmental department shall, in conjunction with relevant departments, formulate a list of key greenhouse gas emission units included in carbon emission trading (hereinafter referred to as key emission units) in accordance with the relevant provisions of the State and this Municipality. 

    Key emission units and other institutions and individuals that meet the relevant regulations may participate in carbon emissions trading. 

The municipal ecological and environmental department shall strengthen the supervision and management of activities related to carbon emissions trading. 

    Article 15 this Municipality shall implement the management of carbon emission quotas for key emission units. 

    The municipal ecological and environmental department shall, in conjunction with relevant departments, allocate carbon emission quotas to key emission units in accordance with the provisions of the State and this Municipality and in accordance with the total amount and distribution plan of annual carbon emission quotas. 

    Key emission units shall control greenhouse gas emissions and complete the payment of carbon emission quotas in accordance with the relevant provisions; if they cannot be paid in full, they may complete the payment by purchasing quotas in the carbon emissions trading market. 

    Article 16 key emission units shall establish a greenhouse gas emission accounting and monitoring system in accordance with the relevant state regulations and technical standards. 

    Key emission units shall, in accordance with the relevant provisions, compile greenhouse gas emission reports and submit them to the municipal ecological and environmental departments. 

    Key emission units shall be responsible for the authenticity, completeness and accuracy of the reported data and information. 

    The original records and management ledgers of the data covered by greenhouse gas emissions reports should be kept for at least five years. 

    After receiving the greenhouse gas emission report of the key emission units, the municipal ecological environment department shall organize verification, and the key emission units shall cooperate. 

    The verification results shall be used as the basis for the settlement of carbon emission quotas for key emission units. 

    The municipal ecological and environmental department may entrust a technical service agency to conduct a technical examination of the greenhouse gas emission report. 

    The entrusted technical service organization shall be responsible for the technical examination opinions put forward by it. 

    The reports and verifications of other units whose annual carbon emissions reach a certain scale shall be carried out in accordance with the relevant regulations. 

    Article 17 this city shall explore the incorporation of carbon emission assessment into the environmental impact assessment of planning and construction projects. 

    Article 18 the development and reform departments, ecological and environmental departments and other departments shall strengthen the supervision and inspection of carbon emissions in accordance with their respective functions and duties, and enterprises, institutions and other producers and operators shall cooperate with the supervision and inspection. 

    The development and reform department, the ecological environment department and other departments may take measures such as on-site monitoring, consulting or copying relevant materials to carry out on-the-spot inspection. 

    Relying on the unified sharing and exchange platform of the city's information resources, the city has established a carbon emission supervision information system, including carbon emissions, supervision and inspection, to achieve resource integration, information sharing and real-time updating. 

    Article 19 this Municipality shall implement the target responsibility system and assessment and evaluation system for carbon peak and carbon neutralization. 

    The municipal people's government shall take the achievement of carbon peak and carbon neutralization targets as the contents of the assessment and evaluation of the relevant departments of the municipal people's government, the district people's government and their responsible persons, and the assessment results shall be announced to the public on a regular basis. 

    Those who fail in the examination shall be interviewed by the Municipal people's Government. 

    Article 20 this Municipality shall bring the relevant departments of the municipal people's government and the district people's governments into the eco-environmental protection inspectors on the implementation of carbon peak, carbon neutralization and relevant laws, regulations and objectives.

    Chapter III Green Transformation. 

    Section 1 adjusting the energy structure. 

    Article 21 the municipal and district people's governments shall take effective measures to build a clean, low-carbon, safe and efficient energy system, optimize and adjust the energy structure, improve the double control system of energy consumption intensity and total amount, promote the production and use of clean energy, gradually increase the proportion of non-fossil energy consumption, and promote energy conservation in key areas and key links.

    Article 23 the municipal and district people's governments shall take measures to strengthen the planning, construction and management of fuel gas infrastructure, improve the transportation network, strengthen the coordination of fuel gas supply, actively and rationally develop natural gas and optimize the structure of natural gas utilization. 

    Article 24 large-scale, advanced and intensive oil processing conversion methods shall be encouraged to improve the utilization efficiency of fuel oil products and reduce     carbon emissions in the process of oil processing conversion and oil products use. 

    Article 25 support the development of non-fossil energy such as wind energy, solar energy, geothermal energy and biomass energy, gradually expand the consumption of non-fossil energy, comprehensively promote the utilization of hydrogen energy, and promote low-carbon energy to replace high-carbon energy. 

    Article 26 this city shall continue to optimize the structure of power consumption, reasonably reduce the generation of coal-fired power units, and increase the proportion of net external power and green power. 

    In accordance with the requirements of the state, implement the responsibility of electricity consumption of renewable energy, support the demonstration application of energy storage, and promote the construction of a new power system with new energy as the main body. 

    Power grid enterprises should strengthen power grid construction, develop and apply smart grid and energy storage technologies, improve their ability to absorb renewable energy power, and support new energy power stations such as solar and wind energy as well as waste heat and residual pressure power stations to be connected to the grid. 

    Article 27 the municipal development and reform department shall, in conjunction with the relevant departments, publish the list of key energy-using units in accordance with the law, and strengthen supervision and administration over the use of energy. 

    Section II promoting Industrial Transformation. 

    Article 28 the municipal and district people's governments shall implement industrial policies conducive to achieving the goals of carbon peak and carbon neutralization, take measures to optimize the industrial structure, and promote the high-end, intelligent and green upgrading of metallurgical, chemical and other traditional industries. 

    This city strictly controls the access of projects with high energy consumption and high emissions, and forbids the addition of new production capacity of steel, cement clinker, flat glass, refining and chemical industry, electrolytic aluminum, etc., except those that implement the relevant industrial planning requirements of the state. 

    Projects that do not meet the requirements of the national industrial plan, industrial policy, ecological protection red line, environmental quality bottom line, resource utilization line, eco-environmental access list, planning environmental assessment, capacity replacement, coal consumption reduction substitution and pollutant emission reduction shall not be examined and approved; projects with high energy consumption and high emission that are examined, approved and constructed in violation of regulations shall be investigated and dealt with in accordance with the law. 

    Article 29 based on the positioning of the national advanced manufacturing R & D base, this Municipality promotes industrial green upgrading, focusing on information technology application innovation, integrated circuits, vehicle networking, biomedicine, new energy, new materials, high-end equipment, automobiles and new energy vehicles, green petrochemical, aerospace and other industrial chains, promote the development of strategic emerging industries and high-tech industries, and speed up the construction of a green and low-carbon industrial system. 

    Promote green design of products, promote green manufacturing, and promote the recycling of resources. 

    Article 30 this Municipality shall promote the construction of a green and low-carbon transportation system, adjust and optimize the transport structure, develop multimodal transport, improve the use efficiency of highways, promote the construction of freight railways, encourage sea-rail transport, and increase the proportion of railway transport. 

    The municipal and district people's governments shall take measures to give priority to the development of public transport, speed up the construction of urban rail transit, improve the public transport network, and increase the proportion of public transport travel. 

    Encourage the application of Internet, big data and other new business type and new technologies in the field of transportation, develop intelligent transportation, and improve transport efficiency and intelligent level. 

    Article 31 this Municipality shall promote the construction of green buildings in new urban buildings in an all-round way; if the new buildings are qualified, prefabricated buildings shall be adopted. 

    Encourage the renovation of existing buildings to implement green building standards. 

    Encourage the construction of green rural houses in rural areas. 

    Encourage and support the research, development, demonstration and promotion of green building technology, and promote the progress and innovation of green building technology. 

    Article 32 this Municipality shall develop green and low-carbon circular agriculture, rationally adjust the structure of planting and aquaculture, encourage ecological cultivation and ecological breeding, popularize agricultural low-carbon production technologies, and promote large-scale and intensive management. 

    Article 33 the municipal and district people's governments shall take measures to promote the transformation and upgrading of traditional service industries such as travel, accommodation, automobile repair, decoration and catering to low energy consumption, promote the green upgrading of commercial and trade enterprises, and speed up the green transformation of the information service industry. we will promote the green development of the convention and exhibition industry and raise the level of green development of the service industry. 

    Section III promoting low-carbon Life. 

    Article 34 this Municipality advocates green and low-carbon life, opposes extravagance and waste, guides and encourages green and healthy consumption patterns and lifestyles, carries out activities to create green life, and creates a new fashion of green and low-carbon life. 

    Article 35 encourage and guide the public to purchase and use energy-saving and low-carbon products, use green packaging and reduced packaging, save water and electricity, save the use of daily necessities, and reduce the use of disposable products. 

    Article 36 the public shall be encouraged to actively participate in green public welfare activities such as voluntary tree planting, wildlife protection, publicity and education on ecological environment protection, etc. 

    Article 37 this Municipality shall promote green travel, strengthen the construction of green travel infrastructure, and encourage and guide the public to give priority to public transport, bicycles, walking and other environmentally friendly and low-carbon travel modes. 

    Article 38 Service enterprises such as catering, entertainment and accommodation shall adopt products that save energy, water and materials and are conducive to the protection of the ecological environment, and reduce or refrain from using products that waste resources and pollute the environment. 

    Article 39 State organs, institutions, state-owned enterprises and other organizations that use financial funds shall strictly practice economy, put an end to waste, use energy-saving, low-carbon products, equipment and facilities that are conducive to environmental protection, and reduce the use of disposable office supplies. Economize the use and reuse of office supplies, and promote paperless office work. 

    Encourage other enterprises and social organizations to economize and reuse office supplies. 

    Article 40 State organs, institutions, state-owned enterprises and other organizations that use financial funds shall strictly implement the relevant state regulations on indoor temperature control of air conditioners, make full use of natural ventilation and improve the operation and management of air conditioners. 

    Encourage other enterprises, social organizations and the public to reasonably control the temperature of indoor refrigeration, heating and other facilities to reduce energy consumption. 

    Article 41 Lighting of public facilities, public places and decorative landscape lighting of large buildings shall, in accordance with the requirements of energy conservation, give priority to the use of power-saving technologies, products and new energy, and optimize the control system in the light of seasonal and weather changes, reduce lighting energy consumption. 

    Article 42 Units and individuals shall consciously abide by the regulations of the State and this Municipality on the management of domestic waste, fulfill the obligations of source reduction and classified release of domestic waste in accordance with the law, and reduce resource consumption and carbon emissions. 

    Article 43 encourage grass-roots mass self-government organizations and social organizations to carry out donation, bazaar, replacement and other activities to promote the reuse of idle goods. 

    Enterprises are encouraged to participate in the recycling of waste items such as old household appliances, furniture and clothing.

    Chapter IV reducing carbon and increasing Foreign Exchange. 

    Section 1 reducing carbon emissions. 

    Article 44 key areas such as energy, industry, transportation and construction, as well as key industries such as iron and steel, building materials, non-ferrous materials, chemical industry, petrochemical industry and electric power, shall take measures to control and reduce carbon emissions, in line with the carbon emission intensity requirements set by the State and this Municipality, and shall not exceed the prescribed total carbon emission control targets. 

    Article 45 production units of products with high energy consumption in the production process shall implement the national energy consumption quota per unit product. 

    The production, import and sale of energy-using products and equipment that are explicitly eliminated by the state and this municipality or that do not meet the compulsory energy efficiency standards are prohibited, and the use of energy-using equipment and production processes explicitly eliminated by the state and this municipality is prohibited. 

    Support energy-using units to adopt high-efficiency and energy-saving equipment, promote cogeneration, waste heat and pressure recovery, energy cascade utilization, the use of low-valley power and advanced energy monitoring and control technologies, and implement alternative transformation of new energy and clean energy, improve the efficiency of energy resources utilization. 

    Article 46 this Municipality shall take measures to promote the application of energy-saving and environment-friendly and new energy motor vehicles and vessels and off-road mobile machinery, and gradually phase out high-emission motor vehicles and vessels and off-road mobile machinery. 

    Transportation, urban management, postal and other departments shall promote the replacement of new energy by motor vehicles and vessels in public transport, logistics, sanitation, postal, express delivery and other industries. 

    Article 47 this Municipality shall strengthen the construction of green ports, support the construction of zero-carbon wharves and demonstration zones in low-carbon port areas in Tianjin Port, promote port operators to adopt clean and low-carbon operation methods, and continuously promote the clean transportation of collection and distribution ports. 

    In the construction, reconstruction and expansion of the wharf, the shore-based power supply facilities shall be designed and constructed at the same time. 

    To promote the use of shore electricity by ships docking in port in accordance with the regulations, and to increase the utilization rate of shore electricity by ships. 

    Article 48 this city integrates the requirements of green and low carbon, energy conservation and environmental protection into urban renewal, the renovation of old residential areas and the establishment of smart cities, so as to promote the low-carbon transformation of urban and rural construction and management mode.

    Article 50 Agricultural producers and operators shall adopt a clean mode of production, apply agricultural inputs such as chemical fertilizers and pesticides scientifically and rationally, and promote the reduction of chemical fertilizers and pesticides to increase efficiency. 

    Agricultural and rural departments should strengthen the guidance, promotion and supervision of agricultural cleaner production, guide the utilization of renewable energy in rural areas, improve the level of resource utilization of livestock and poultry manure, and promote the comprehensive utilization of crop straw. 

    Article 51 this Municipality shall take effective measures to reduce the production of solid waste, promote the comprehensive utilization of solid waste, withdraw from landfill disposal in accordance with state regulations, and reduce carbon emissions. 

    Article 52 We shall encourage the use of reclaimed water, seawater desalination water and seawater, take measures to optimize the allocation of multiple water sources, continuously implement the technological transformation of water conservation in enterprises and agriculture, make scientific and rational use of water resources, and improve the efficiency and efficiency of water use.

    Article 53 this Municipality shall take measures to enhance the capacity of ecological carbon sequestration, strengthen land and spatial planning and use control, strictly abide by the red line of ecological protection, strengthen the ecological protection and restoration of natural protected areas, improve the carrying capacity of natural ecological space, and enhance the stability of the ecosystem, effectively give full play to the carbon sequestration role of forests, wetlands, oceans and soil, and enhance the increment of ecosystem carbon sequestration. 

    Article 54 this city shall carry out afforestation scientifically, promote the construction of green ecological barriers, gradually increase forest coverage, strengthen the protection and restoration of forest ecosystems, and enhance the capacity of forest carbon sequestration. 

    No unit or individual may move or cut down trees without authorization or occupy urban greening land. 

If it is really necessary to occupy forest land or urban greening land temporarily due to special reasons, it shall go through the relevant formalities in accordance with the provisions of relevant laws and regulations and restore them on schedule. 

    Article 55 this Municipality shall strengthen the protection and restoration of the wetland ecosystem, improve the wetland protection system, maintain the safety of the wetland ecosystem, and enhance the carbon sequestration capacity of the wetland. 

    It is forbidden to open (encircle) reclamation, landfill or drain wetlands, and permanently cut off the water sources of wetlands. 

    The municipal planning and resources department shall regularly monitor and evaluate the protection of important wetlands and conduct regular investigations on wetland resources and their biodiversity. 

    Article 56 this Municipality shall strengthen the protection of marine ecosystems, strengthen the protection and management of marine nature reserves and other areas, strengthen the monitoring, protection and ecological restoration of marine ecological environment, and enhance the capacity of marine carbon sequestration. 

    In marine nature reserves, seaside scenic spots, important fishery waters and other areas in need of special protection designated according to law, they shall not engage in the construction of coastal engineering projects or other activities that pollute the environment or destroy the landscape. 

    Article 57 this city shall strengthen the protection of soil ecosystem, strengthen the protection and management of agricultural land, and take scientific and reasonable measures to enhance the capacity of soil carbon sequestration. 

    Article 58 Enterprises and institutions shall be encouraged to develop carbon sequestration projects and to realize the incentive effect of carbon sequestration projects to replace or reduce carbon emissions through carbon emissions trading. 

    Article 59 the municipal planning and resources department shall, in conjunction with relevant departments, organize the construction of carbon sequestration databases and dynamic monitoring systems for ecosystems such as forests and wetlands, and carry out carbon sequestration accounting on a regular basis.

    Chapter V Scientific and technological Innovation. 

    Article 60 this Municipality shall build a carbon peak and carbon neutral science and technology support system, improve the mechanism of scientific and technological awards and evaluation of scientific and technological personnel, and promote major scientific and technological innovation and engineering demonstration of carbon peak and carbon neutralization. Establish and improve the green low-carbon technology evaluation, trading system and scientific and technological innovation service platform to stimulate the vitality of carbon peak and carbon neutral scientific and technological innovation. 

    Article 61 Scientific research institutions, institutions of higher learning and enterprises are encouraged to carry out basic research on the application of carbon peak and carbon neutralization, and to strengthen applied research such as energy conservation and carbon reduction, carbon emission monitoring and carbon sink accounting, so as to improve the supporting capacity of scientific research. 

    Article 62 support scientific research institutions, institutions of higher learning and enterprises to carry out innovative R & D, demonstration and promotion of low-carbon, zero-carbon and negative carbon, clean and renewable energy, circular economy and other technologies, products and services. 

    We will support enterprises to integrate the resources of scientific research institutions, institutions of higher learning, and joint industrial parks to establish green technology innovation consortia, project incubators, and innovation and entrepreneurship bases for market-oriented operation. 

    The municipal and district people's governments shall, by means of research and development subsidies, demonstration and promotion, post-subsidies, give priority to and focus on supporting projects related to the transformation of scientific and technological achievements of carbon peak and carbon neutralization, and actively promote the transformation of scientific and technological achievements. 

    The municipal science and technology department shall incorporate energy conservation and low-carbon technologies into the city's scientific and technological innovation plan. 

    Article 63 encourage the research and development, demonstration and industrial application of carbon capture, utilization and storage technologies, and encourage thermal power, iron and steel, petrochemical and other enterprises to carry out technological transformation of carbon capture and utilization. 

    Article 64 the municipal department of development and reform shall, in conjunction with relevant departments, issue a catalogue for the promotion of green technology to guide units and individuals to use advanced green technology and energy-saving products. 

    Article 65 support scientific research institutions, institutions of higher learning and enterprises to train professionals related to carbon peak and carbon neutralization, encourage the introduction of high-end talents in green and low-carbon fields, and promote the construction of a platform for personnel training and exchange.

    Chapter VI incentive measures. 

    Article 66 the municipal and district people's governments shall raise funds in various ways and support the carbon peak and carbon neutralization related work by means of financial subsidies. 

    Article 67 the municipal development and reform department shall, in accordance with the state industrial policy, improve the differential price and ladder price policy for industries with high energy consumption and high emissions in accordance with the law, guide the economical and rational use of water, electricity, gas and other resources and energy, and reduce carbon emissions. 

    Article 68 this Municipality shall establish and improve the compensation mechanism for ecological protection, and promote the formation of a market-oriented and sustainable mechanism for realizing the value of ecological products led by the government, with the participation of enterprises and all sectors of society. 

    Article 69 encourage and support the development of green and low-carbon finance, guide financial institutions to develop new financial products, and increase credit support for low-carbon energy-saving projects, eligible projects such as the research and application of low-carbon and new energy technologies, the production of low-carbon products and energy-saving transformation will be listed as key investment areas to provide financial services. 

    Encourage the absorption of social funds to participate in energy conservation and emission reduction investment, technology research and development, technology promotion, carbon emissions trading and other activities. 

    Article 70 the ecological and environmental department shall include the performance of carbon emissions trading of key emission units in the credit record and push it to the credit information sharing platform. 

    Relevant departments and units may implement incentive measures on key emission units that are trustworthy in accordance with the law. 

    Financial institutions and other market entities are encouraged to give preferential treatment or convenience to trustworthy key emission units. 

    Article 71 this city shall explore the establishment of a carbon inclusive mechanism, promote the construction of a carbon inclusive service platform, and guide the green and low-carbon production and life of the whole society through policy incentives and market incentives. 

    We will encourage qualified regions, enterprises and institutions to carry out demonstration construction of near-zero carbon emissions and carbon neutralization.

    Chapter VII legal liability. 

    Article 72 if the people's governments at all levels and relevant departments abuse their power, neglect their duties, engage in malpractices for personal gain or commit other illegal acts in the carbon peak and carbon neutralization work, they shall be ordered by the competent authorities to make corrections, and the persons directly in charge and other persons directly responsible shall be dealt with according to law; if the case constitutes a crime, criminal responsibility shall be investigated according to law. 

    Article 73 whoever, in violation of the provisions of these regulations, fails to pay off the carbon emission quota or fails to pay the carbon emission quota in full shall be ordered by the municipal ecological environment department to correct it. Impose a fine of not less than five times and not more than ten times the average transaction price of the market one month before the time limit for the settlement of carbon emission quotas that have not been paid or not fully paid. 

If it refuses to make corrections, the municipal ecological and environmental department shall, in accordance with laws and administrative regulations, order the suspension of production and regulation, and shall, in accordance with the unpaid or underpaid parts, equally reduce its carbon emission quota for the next year. 

    Article 74 whoever, in violation of the provisions of these regulations, a key discharge unit commits any of the following acts shall be ordered by the municipal ecological and environmental department to make corrections and imposed a fine of not less than 20, 000 yuan and not more than 200000 yuan; if he refuses to make corrections, the municipal ecological and environmental department shall, in accordance with laws and administrative regulations, order the suspension of production for rectification: 

    (1) failing to establish a greenhouse gas emission accounting and monitoring system in accordance with the relevant provisions. 

    (2) failing to compile and submit greenhouse gas emission reports in accordance with the relevant provisions. 

    (3) failing to keep the original records and administrative accounts of the data involved in the greenhouse gas emission report in accordance with the relevant provisions. 

    Article 75 if a production unit, in violation of the provisions of these regulations, uses energy in excess of the energy consumption quota of unit products, it shall be ordered by the competent department in charge of energy conservation to control it within a time limit; if the circumstances are serious and fail to do so within the time limit, the competent department for energy conservation may put forward its opinions and apply to the people's government at the corresponding level to order it to suspend business for rectification or close down in accordance with the limits of authority prescribed by the State Council. 

    Whoever produces, imports or sells energy-using products and equipment that do not meet the compulsory energy efficiency standards shall be ordered by the market supervision department to stop the production, import and sale, confiscate the illegal production, import and sale of energy-using products, equipment and illegal income, and concurrently impose a fine of not less than one time and not more than five times of the illegal gains; if the circumstances are serious, the business license shall be revoked according to law. 

    Whoever uses the energy-using equipment or production technology explicitly eliminated by the state or this municipality shall be ordered by the department in charge of energy conservation to stop the use and confiscate the energy-consuming equipment that has been expressly ordered to be eliminated; if the circumstances are serious, the competent department for energy conservation may put forward its opinions, report to the people's government at the corresponding level to order it to suspend business for rectification or close down in accordance with the limits of authority prescribed by the State Council. 

    Article 76 any construction unit that violates the building energy efficiency standards shall be ordered by the housing department of urban and rural construction to make corrections and impose a fine of not less than 200000 yuan but not more than 500000 yuan. 

    If the design unit, construction unit or supervision unit violates the building energy efficiency standards, the housing urban and rural construction department shall order it to correct and impose a fine of not less than 100,000 yuan and not more than 500000 yuan; if the circumstances are serious, the department that issued the qualification certificate shall lower the qualification grade or revoke the qualification certificate in accordance with the law. 

    Article 77 whoever illegally fells trees in violation of the provisions of these regulations shall be ordered by the competent forestry department to replant trees with not less than one time but not more than five times the number of illegally felled trees in the same place or in other places within a time limit, and impose a fine of not less than five times and not more than ten times the value of illegally felled trees. 

    In case of indiscriminate felling of trees, the competent forestry department shall order them to replant not less than one time but not more than three times the number of indiscriminately felled trees in place or in other places within a time limit, and may impose a fine of not less than three times and not more than five times the value of indiscriminately felled trees. 

    Those who move or cut down urban trees without approval shall be ordered by the urban administrative department to replant within a time limit; those who move without authorization shall also be fined not less than three times and not more than five times the benchmark value of the trees, and shall also be fined not less than five times but not more than ten times the benchmark value of the trees. 

    Whoever occupies urban greening land without permission shall be ordered by the urban administrative department to restore the original state within a time limit, and may be fined not less than 100 yuan but not more than 300 yuan per square meter according to the occupied area. 

    Article 78 whoever, in violation of the provisions of these regulations, opens (encircles) reclamation, landfills or drains wetlands, or permanently cuts off the water sources of wetlands, shall be ordered by the relevant departments of the city and relevant districts to stop the illegal acts, restore the original ecological function within a time limit or take other remedial measures, and concurrently impose a fine of not less than 5,000 yuan and not more than 50, 000 yuan; if serious consequences are caused, a fine of not less than 50, 000 yuan and not more than 500000 yuan shall be imposed. 

    Article 79 whoever, in violation of the provisions of these regulations, causes damage to the marine ecosystem, marine aquatic resources or marine protected areas shall be ordered by the department exercising the power of marine environmental supervision and administration to make corrections and take remedial measures within a time limit.     A fine of not less than 10,000 yuan and not more than 100,000 yuan shall be imposed; if there are any illegal gains, the illegal gains shall be confiscated. 

    Article 80 the relevant departments shall, in accordance with the provisions, incorporate the information of illegal acts in violation of these regulations into the credit information sharing platform and punish them for breach of trust in accordance with the law. 

    Article 81 where a violation of the provisions of these regulations has been dealt with by laws or administrative regulations, such provisions shall prevail; if the violation constitutes a crime, criminal responsibility shall be investigated according to law.

    Chapter VIII Supplementary provisions. 

    Article 82 this Law shall enter into force as of November 1, 2021.
