Chapter 2 Planning and Standards


Article 8 The competent departments of the housing urban and rural construction of the Provincial People's Government shall, in accordance with the provincial standardization departments in accordance with national standards, combine the natural environmental conditions and economic development levels of the province, formulate relevant local standards for green buildings, and establish and improve the standard system of green building standards.

Chapter III Construction and Transformation

Article 16 The construction unit shall include relevant content such as the design documents and the requirements of the green building standards in accordance with the qualified construction map design documents and the requirements of green building standards into the construction plan and organize the implementation. Article 20 Encourage farmers to build self -built houses with reference to the construction of green building standards. Chapter 5 Operation and Security


Article 29 The operation of green buildings shall meet the following requirements:

(1) Complete operation management system;

(3) Equipment systems such as ventilation, air conditioning, lighting, water, electricity and other equipment are running normally;

(4) Power -saving and water -saving indicators meet the regulations of the country and the province;

(5) Environmental indicators such as temperature and humidity, noise, air quality and other environmental indicators in the room meet the standards;

(6) The discharge and disposal of waste gas, sewage, solid waste and other harmful substances meet the regulations of the country and the province.

Article 33 The people's governments at or above the county level shall focus on supporting the following work:

(1) Preparation of special planning for green building development;

(2) Green buildings, new construction industrialization technology, product research and development and promotion;

(3) Demonstration of projects such as green buildings, prefabricated buildings, ultra -low energy consumption buildings;

(4) Green transformation of existing buildings;

(5) The development of production bases such as industrialization, green building materials such as new construction;

(6) Green building related work such as green building standards and energy consumption monitoring platform construction and operation and maintenance platform.


Article 34 For the research and development of new green buildings, build, purchase, use green buildings, or carry out green transformation of existing civilian buildings, and implement the following incentive measures:

(1) R & D expenses of new green buildings, new processes, new products and new equipment, can enjoy preferential tax policies in accordance with relevant national regulations;

(2) The construction area increased by the use of wall insulation technology is not included in the plot ratio;

(3) Green buildings with prefabricated construction methods, which meet the construction area of the requirements of the pre -assembly building, can be calculated in accordance with the proportion of the state and local regulations;

(4) For the air garden balcony that meets the requirements in the aspects of the space height, the depth of the green coverage, and the proportion of the area of greening, the people's governments at or above the county level can give rewards and support in accordance with relevant regulations;

(5) Encourage financial institutions to provide green financial services to green financial services through various methods such as green credit, green insurance, and green bonds through green credit, green insurance, and green bonds;

(6) Use housing provident fund loans to purchase green buildings higher than the minimum level of self -residential housing, and the loan amount can float in accordance with the specified proportion;

(7) For green construction projects that reach the second -star level or above, you can first recommend it in the review of various construction project awards.


Chapter 6 Legal Responsibility

Article 37 In violation of Article 14 of these regulations, the design unit does not design in accordance with the green building level and standards, or selects materials, components, and equipment that does not meet the requirements of green building standards. Article 38: In violation of Article 15 of these Regulations, the construction drawing design document review agency issues a review of the construction drawing design documents that do not meet the requirements of green building levels and standards. Ordered correction, fined 30,000 yuan, and recorded in credit files; if the circumstances are serious, the housing urban and rural construction department of the Provincial People's Government will no longer include it in the list of review agencies.


Article 39: If the provisions of Article 16 of these Regulations, if the construction unit fails to organize the construction of the construction map and the green building standards, it shall be ordered by the competent housing urban and rural construction department of the people's government at or above the county level. Article 40 In violation of Article 17 of these regulations, if the supervision unit fails to implement supervision in accordance with the requirements of the construction map design documents and green building standards, shall be ordered by the competent housing urban and rural construction department of the people's government at or above the county level. For fines of less than 100,000 yuan or less; if it causes losses, it shall bear the liability for compensation according to law.


Article 41: If the provisions of Article 18 of these Regulations, the construction unit shall be issued a qualified report of the construction project that does not meet the construction map design documents and the requirements of green building standards shall be ordered Raiders, more than four percent of the contract price of construction projects or less; if it causes losses, it shall bear the liability for compensation according to law.


Article 42 In violation of Article 19 of these regulations, real estate development enterprises have not reached the green building level and main technical measures of the houses sold in the green building commercial housing sales contract and residential quality guarantee, and the residential use instructions. The competent housing urban and rural construction department at or above the county level shall order corrections within a time limit; if the overdue is not corrected, the total sales of houses will be delivered by less than two % of the total amount of house sales will be fined.


Article 43 In violation of the provisions of these regulations, the housing urban and rural construction department of the people's government at or above the county level, and other relevant departments and other relevant departments and their staff, who have neglected their duties, abuse their powers, and have fraudulent behaviors.
