In order to actively and steadily promote carbon peak carbon neutrality, promote the comprehensive green and low-carbon transformation of economic and social development, and promote the construction of ecological civilization, the Zhejiang Provincial Department of Justice has publicly solicited comments on the "Regulations on the Promotion of Green and Low-carbon Transformation in Zhejiang Province (Draft for review)", details are as follows:

Chapter I General rules


Article 1 [Legislative Purpose and Basis] These Regulations are formulated in accordance with the relevant laws and administrative regulations and in light of the actual conditions of this province in order to actively and steadily promote carbon neutrality to reach the peak of carbon, promote the comprehensive green and low-carbon transformation of economic and social development, and promote the construction of ecological civilization.


Article 2 [Scope of Application] These Regulations shall apply to activities related to green and low-carbon transformation in energy, industry, construction, transportation, agriculture, residential life and other fields within the administrative area of this province.


Article 3 The green and low-carbon transition should follow the principles of government guidance, market leadership and social participation, and jointly promote carbon reduction, pollution reduction, green expansion and growth, so as to achieve high-quality development and high-level protection.


Article 4 People's governments at or above the county level shall establish a leadership mechanism for carbon peaking and carbon neutrality, incorporate the goals and tasks of green and low-carbon transformation into national economic and social development plans, coordinate and promote major reforms, study and formulate major policies, and coordinate and solve major problems.


Township people's governments, sub-district offices, and residents' (village) committees shall cooperate in the relevant work of green and low-carbon transformation.


Article 5 The competent departments of development and reform shall coordinate the construction of ecological civilization, take the lead in carbon peaking and carbon neutrality, formulate and improve policies and measures related to green and low-carbon transformation, coordinate and promote the implementation of work, and promote the gradual shift from dual control of energy consumption to dual control of carbon emissions.


Economic and information technology, science and technology, finance, natural resources, ecological environment, housing urban-rural development, transportation, agriculture and rural areas, commerce, market supervision and management, local financial supervision, statistics, government affairs, energy, forestry, meteorology and other competent departments shall, in accordance with the division of responsibilities, do a good job in green and low-carbon transformation related work.


Article 6 Government agencies, public institutions, enterprises and other producers and operators shall implement the requirements for green and low-carbon transformation in accordance with the law, adopt green and low-carbon technologies and ways of production and life, and conserve and intensively use energy resources.


Citizens should enhance the awareness of resource conservation and green and low-carbon, and adopt a simple, moderate, green and low-carbon lifestyle.


Article 7 People's governments at or above the county level and their relevant departments shall strengthen the publicity and popularization of laws, regulations and policies related to green and low-carbon transformation, and organize relevant activities such as World Environment Day, National Ecological Day, low-carbon Day and energy-saving publicity Week.


Education authorities should incorporate green and low-carbon related content into the school education and teaching system to cultivate students' green and low-carbon awareness.


The news media should play the role of public opinion guidance and supervision, publicize and popularize green and low-carbon knowledge, and advocate low-carbon lifestyle and consumption concept.


Article 8 People's governments at or above the county level shall strengthen cross-regional cooperation with the Yangtze River Delta region and other regions in green and low-carbon transformation, and jointly promote low-carbon technology research, industrial collaborative innovation, and energy mutual relief and mutual protection.


Chapter II Basic system


Article 9 People's governments at or above the county level shall implement a comprehensive conservation strategy, improve systems and systems for the economical and intensive use of resources such as energy, water, grain, land, minerals and raw materials, and promote total control, scientific allocation, recycling and efficient use of various resources.


Tenth [dual control of energy consumption] the provincial energy department should improve the dual control of energy consumption, implement renewable energy consumption, raw material energy use, etc. are not included in the energy consumption dual control assessment, optimize and improve the regulation methods, establish and improve energy conservation review, energy use budget management, energy use rights paid use and trading, energy conservation supervision and other systems.


Article 11 The provincial people's government and its relevant departments shall establish and improve the double control degree of total carbon emission and intensity according to the unified deployment of the state.


The provincial development and reform departments shall, together with the provincial ecological environment, statistics, energy and other competent departments, strengthen the basic capacity building of carbon emission dual control, and improve the supporting systems of carbon emission statistical accounting, carbon emission evaluation, and carbon emission budget management.


Article 12 [Statistical accounting of carbon emissions] The provincial statistical department shall, in conjunction with the provincial ecological environment, development and reform departments, establish a provincial statistical accounting system for carbon emissions in accordance with national regulations, organize the formulation of statistical accounting methods for carbon emissions in cities with districts, and carry out carbon emissions accounting in the province and cities with districts.


Article 13 [Carbon emission evaluation] The provincial development and reform departments shall establish a carbon emission evaluation system, implement the national requirements for carbon peaking carbon neutral analysis in the feasibility study report of investment projects, and clarify the scope and evaluation standards for carbon emission evaluation.


Article 14 [Standards and norms] The provincial market supervision and administration department shall, together with relevant departments, establish a green and low-carbon standard system, and urge and guide relevant departments to formulate green and low-carbon standards in batches by field.


Provincial development and reform, ecological environment, economy and information technology, market supervision and management departments shall formulate industry and product carbon footprint standards, explore the establishment of provincial carbon footprint database, and carry out the full life cycle carbon footprint accounting and certification of key products.


Market supervision and administration departments shall formulate technical specifications for carbon measurement, promote the measurement of carbon emissions in different regions, industries and enterprises, and carry out energy measurement review of key emission units and carbon emission measurement review.


Encourage industry associations, industry alliances and related enterprises to actively introduce and participate in the formulation of green and low-carbon standards at home and abroad, and participate in the construction of carbon footprint database.


Article 15 [National carbon trading, regional voluntary emission reduction trading] Provincial ecological environment authorities shall improve the carbon emission monitoring, reporting and verification system of key enterprises, promote key emission units to participate in the national carbon trading market, guide relevant enterprises to actively develop voluntary emission reduction projects, and carry out carbon asset management.


Ecological environment, provincial development and reform departments should take the lead in voluntary carbon inclusive emission reduction management, carry out carbon inclusive emission reduction certification filing and cancellation, explore the establishment of regional carbon inclusive voluntary emission reduction trading mechanism, and carry out carbon sink trading in forestry, Marine, wetland and other areas.


Encourage large-scale events (conferences), low (zero) carbon pilot creation, ecological justice, etc., to achieve carbon neutrality and ecological environmental damage compensation through the purchase of carbon inclusive emission reduction.


16th [green electricity consumption system] provincial development and reform departments should standardize the issuance of green certificates in accordance with the national unified deployment, promote green certificate transactions, and encourage energy units to buy green certificates.


Provincial energy authorities should study and formulate high energy consumption enterprises green power consumption responsibility and other related policies, multiple channels to expand clean power from outside the province into Zhejiang.


People's governments at or above the county level and their relevant departments shall promote the development and consumption of green certificates and organize the purchase of green certificates outside the province.


Article 17 The provincial competent department of natural resources shall, in conjunction with relevant departments, improve the system of integrated protection and systematic restoration of mountains, rivers, forests, fields, lakes, grass and sea, establish a management mechanism for the construction of a natural protected area system, and improve the red line management system for ecological protection.


The provincial finance department shall, together with the provincial development and reform, natural resources, ecological environment, agriculture and rural areas, water conservancy and other competent departments, improve the market-oriented diversified ecological protection compensation system, and improve the financial award and subsidy mechanism for green development.


The provincial development and reform department shall, in conjunction with relevant departments, improve the application mechanism for accounting the total value of ecological products in administrative regional units and the value of ecological products in specific regional units, and establish a basic information investigation and dynamic monitoring system for ecological products.


Chapter III Clean energy


Article 18 [New Energy System] The provincial people's government and its relevant departments shall, in accordance with the national planning and layout, base on the resource endowment of the province, build a new type of power system with zero carbon and low-carbon energy as the development direction and clean and efficient fossil energy as the backing guarantee, and accelerate the planning and construction of a new energy system.


The people's governments at or above the county level and their relevant departments shall implement the task of building a new energy system in light of the actual conditions of their respective regions.


Article 19 [Nuclear Power Construction] The provincial people's government shall actively develop coastal nuclear power in a safe and orderly manner, coordinate the province's nuclear power development planning and layout, and coordinate the approval and construction of nuclear power projects.


The relevant municipal, county (city, district) people's governments shall, in accordance with the national and provincial planning and layout, do a good job of public participation in nuclear power projects, land expropriation and demolition and information disclosure, promote the construction of nuclear power projects, and do a good job of protecting nuclear power plant sites.


Encourage nuclear power enterprises to make use of advanced reactors, promote the comprehensive utilization of nuclear energy such as district heating, industrial heating (cooling), isotope production, seawater desalination, and hydrogen production, and promote the coupling development of nuclear energy with energy-intensive industries.


Article 20 [renewable energy] The provincial energy department shall organize the preparation of renewable energy development and utilization plans, clarify the requirements for the development goals of renewable energy in each district, and incorporate the development and consumption of renewable energy into the assessment and evaluation.


The people's governments of relevant cities, counties (cities, districts) shall speed up the development of offshore wind power, build offshore wind power bases, and promote far-reaching offshore wind power demonstrations.


People's governments at or above the county level and their relevant departments shall promote the development and utilization of centralized and distributed photovoltaics, and support the integration of photovoltaics with construction, transportation, industry, agriculture, and communication facilities.


The provincial competent department of natural resources shall, together with the provincial competent department of forestry, strengthen the security of land, forest and sea use, and formulate technical guidelines for the composite construction of renewable energy.


Article 21 [Clean and efficient utilization of fossil energy] The provincial energy authority shall orderly promote the construction and transformation of clean and efficient coal power units, and promote the construction of large and efficient gas power projects.


The people's governments of relevant cities, counties (cities, districts) shall, in accordance with the national and provincial planning and layout, do a good job of protecting the site of thermal power project planning and expansion, shall not arbitrarily change the use of thermal power projects, shall not hinder the implementation of thermal power projects, and promote the integrated development of production, life and ecology of thermal power plants and surrounding areas.


People's governments at or above the county level shall properly control the growth of coal consumption, promote the clean and efficient use of coal, implement coal reduction and substitution in an orderly manner, encourage natural gas consumption in light of local conditions, promote the substitution of electric energy, and gradually promote the transformation and application of carbon dioxide capture and utilization technology in thermal power, building materials, chemical and other industries.


Article 22 [Hydrogen energy utilization] The provincial people's government shall define hydrogen energy as an integral part of the future energy system and explore the application of hydrogen energy in transportation, energy storage, distributed power generation, industry and other fields.


The provincial development and reform department shall, together with the provincial energy, housing urban and rural construction, economic and information technology departments, formulate hydrogen energy industry development plans and industrial policies, rationally layout hydrogen production facilities, build storage and transportation systems, and plan hydrogenation networks.


Emergency management, housing urban and rural construction, energy and other competent departments shall, in accordance with the division of responsibilities, do a good job of hydrogen production, hydrogenation (including hydrogenation integrated station) safety production supervision and management and hydrogen transmission pipeline protection, according to law to issue hazardous chemical safety production permits, except renewable energy hydrogen production.


People's governments at or above the county level shall fully implement their territorial supervision responsibilities, strengthen the development and investment guidance of the hydrogen energy industry, study and formulate policies to support the development of hydrogen energy, and strengthen the safe production management of hydrogen energy.


Article 23 [Pumped Storage] The provincial people's government and its relevant departments shall clearly define pumped storage power stations as the main power source for regulation, scientifically and orderly promote the construction of pumped storage power stations according to the needs of new energy development and power system operation, and promote the joint construction and sharing of pumping and storage in the Yangtze River Delta.


24th [new energy storage] provincial energy authorities should reasonably plan the layout of new energy storage projects, regulate energy storage project access management, formulate relevant policies and standards, responsible for the power side, grid side energy storage power station safety management.


Emergency management, housing urban and rural construction, energy, economy and information and other competent departments shall, in accordance with the division of responsibilities, do a good job in the safety management of various new energy storage projects and the decommissioning management of energy storage power station batteries, and carry out supervision and inspection according to law and regulations.


Enterprises are encouraged to strengthen technological innovation, carry out demonstrations of new energy storage projects, and actively participate in multi-scenario applications such as peak regulation, frequency modulation, and power auxiliary services.


Chapter four green production


25th [Green and low-carbon industry] Provincial development and reform departments should study and formulate a green and low-carbon industry guidance catalogue, combined with the characteristics and advantages of various places, overall layout of green and low-carbon industrial clusters, promote green and low-carbon advanced technology demonstration projects, and increase the key industries of land, energy consumption, investment and financing and other elements of support.


People's governments at or above the county level should, in combination with their own endowment advantages, increase the cultivation of green and low-carbon industries, give play to the leading role of industry enterprises, build an upstream and downstream low-carbon industrial chain and supply chain, and promote the upgrading of the industrial system to low-carbon, green and high-end.


Article 26 [Industrial carbon Reduction] The provincial economic and information technology authorities shall, together with the provincial development and reform and energy authorities, promote the construction of green manufacturing systems, promote the transformation and upgrading of traditional manufacturing industries, and achieve the goal of reducing energy consumption per unit of industrial added value and carbon emissions per unit of industrial added value.


People's governments at or above the county level shall strictly implement the industrial policies of petrochemical, chemical and other industries, and strictly implement the policies of equal production capacity, reduction and replacement of steel, cement clinker and other industries.


People's governments at or above the county level and their relevant departments shall formulate incentive policies to promote the transformation and upgrading of traditional industrial enterprises through capital, science and technology, personnel and other support.


27th [Industrial energy efficiency improvement] provincial development and reform, economic and information technology, energy authorities should strengthen energy efficiency guidance, introduce differentiated energy efficiency access standards for new projects in subdivided industries, and the energy efficiency of new projects should reach the industry benchmark level.


The provincial energy competent department shall regularly carry out energy efficiency diagnosis of key industries, and force energy saving and carbon reduction technology transformation for those that fail to meet the national and local energy consumption quota standards.


Encourage relevant enterprises to increase the application of green and low-carbon technologies, strengthen energy consumption monitoring and energy-saving management in production processes, speed up the application of high-efficiency and energy-saving motors, boilers, kilns, fans, pumps and other equipment, and must not produce, import or sell energy-using products and equipment that are eliminated by the state or do not meet the mandatory energy efficiency standards. It is prohibited to use energy-using equipment and production processes that have been eliminated by the State.


Article 28 The provincial competent department of housing and urban and rural construction shall, together with the provincial competent department of energy, formulate energy consumption and carbon emission quota standards for public buildings.


Public institution buildings and large public infrastructure should build distributed photovoltaic power generation facilities in accordance with national and provincial regulations.


Encourage construction units to strengthen the concept of green and low-carbon planning and design, strengthen the application design of green buildings, ultra-low energy consumption buildings, and near-zero energy consumption buildings, and implement green construction and green construction requirements.


Article 29 The provincial people's government and relevant departments shall, in accordance with relevant national laws, regulations and policy standards, promote the equipment of transport vehicles with new energy, and formulate a schedule for the elimination of low-emission standard diesel vehicles.


The people's government of the city divided into districts shall assume the main responsibility for the adjustment of the transportation structure, accelerate the construction of infrastructure such as multimodal transport hubs, and promote the transfer of bulk cargo transport from roads to waterways and railways through policy and financial support.


The people's government at or above the county level shall guide the green and low-carbon development of logistics enterprises in the region, and give appropriate preference to green logistics enterprises in finance, insurance and other policies.


Article 30 The competent departments of agriculture and rural areas shall clarify the goals and timing of the elimination and transformation of old and energy-consuming agricultural machinery and old fishing vessels, and accelerate the installation of advanced and new energy sources
