On July 27, 2023, the fourth meeting of the Standing Committee of the 16th Municipal People's Congress conducted the first review of the Regulations on the Green Development of Beijing Buildings (Draft) (hereinafter referred to as the draft Regulations), and a total of 31 members of the Standing Committee expressed their opinions on the draft regulations. It believes that the draft regulations implement the deployment requirements of the Central Government and the Municipal Committee on the green, low-carbon and high-quality development of the construction sector, and carry out the system design around the "whole life period, all fields involved, and the whole industrial chain", which is highly targeted, feasible measures, and generally relatively mature. At the same time, it puts forward some suggestions on further standardizing construction requirements, strengthening operation and maintenance transformation, strengthening scientific and technological support and policy guidance, and promoting industrial development.


In order to practice the whole process of people's democracy, widely gather public opinion, gather people's wisdom, and improve the quality of legislation, the Standing Committee of the Municipal People's Congress contacted the working mechanism of the Standing Committee of the District People's Congress through the members of the director's meeting, and widely listened to the opinions and suggestions of the deputies of the People's Congress, construction units, supervision units, operating units, relevant departments of the district government, streets and towns, experts and scholars. At the same time, the Urban Construction and Environmental Protection Office continued to play the role of the representative thematic research group, and solicited the suggestions of the research group in multiple rounds according to the progress of the draft revision. Special research was conducted on prefabricated farm houses and green and low-carbon building technologies, and legislative symposia focused on industrial development and policy guidance were held to listen to the opinions of relevant financial institutions and professional units; Public opinions were solicited through the portal of the Standing Committee, and opinions were solicited from the Beijing Urban Planning Society and other grass-roots legislative contacts and some law schools. During the period, the Standing Committee of the Municipal People's Congress led the team to carry out research, listened to the situation for many times, and put forward clear requirements and specific opinions on the revision of the draft. On this basis, the Urban Construction and Environmental Protection Office jointly studied and demonstrated with the Legal Affairs Office, the Municipal Bureau of Justice, and the Municipal Housing and Construction Commission, repeatedly communicated and coordinated on key aspects, and basically reached a consensus.


On September 8, the Urban Construction Environmental Protection Committee held the third meeting to study and put forward the "Beijing Green Building Development Regulations (Draft Second Review draft)". The main contents of the changes are reported as follows:


First, improve the overall requirements


Some members of the Standing Committee, deputies and relevant parties have proposed that it is necessary to start from adhering to the strategic positioning of the capital city, promote green, low-carbon and high-quality development in the construction sector, coordinate economic and social development with the application of advanced technologies, actively explore innovation, and give full play to the exemplary and leading role. It is suggested to supplement and improve the relevant content and adjust some expressions, specifically:


First, to further improve the basic requirements for the green development of buildings, increase the applicability and economy of taking into account the application of green and low-carbon technologies, actively take the lead in policy supply, technology application, industrial support and other aspects, encourage scientific and technological research and development, strengthen green and low-carbon cooperation in the construction field in the Beijing-Tianjin-Hebei region, and optimize and adjust the relevant expressions. Second, it is clearly proposed in the general provisions to strengthen the whole process of engineering consultation and promote the implementation of the requirements of green development of buildings. (Article 7 (3) of the Second Draft)


The third is to change the name of the third chapter "Operation and transformation" to "operation and maintenance and transformation".


2. Requirements for standardized construction


Some members and deputies of the Standing Committee and relevant parties have suggested that it is necessary to focus on the management of the whole life cycle of buildings, strengthen the quality control of supervision, improve the promotion mechanism of building materials, strengthen the guidance and supervision of acceptance inspection, complete the provisions on building demolition, and improve the management of construction waste. It is suggested to supplement and optimize the relevant content, specifically:


First, improve the promotion and use of building materials, and expand the scope of promotion from green building materials to safe and durable, energy-saving and low-carbon, excellent performance, health and environmental protection building materials and equipment and facilities; Further standardize the formulation and revision procedures of the list of prohibited use of building materials, clearly stipulate that fair competition review is required in accordance with the law, and the principle of scientific demonstration and public participation is implemented. The second is to refine the construction supervision requirements, it is clear that the supervision unit finds that the construction unit has not carried out the construction in accordance with the requirements, and has the right to request correction, and if it refuses to correct, the supervision unit has the right to report to the construction unit and the competent department. The third is to strengthen the guidance and supervision of the acceptance inspection, stipulating that the housing urban and rural construction departments should perfect and refine the acceptance inspection specifications. (Second reading draft Article 20, paragraph 2)


The fourth is to promote the green demolition of buildings, clarify that the urban management department is responsible for the supervision of construction waste disposal, and add a new provision for the construction waste disposal and demolition site construction requirements. Third, on strengthening operation and maintenance and transformation


Some members of the Standing Committee, deputies, and relevant parties have pointed out that it is necessary to give full play to the role of legislation in guaranteeing and promoting development. In view of prominent problems in practice, such as heavy construction and light operation, and difficulties in upgrading, we will further clarify the responsibilities of the government in overseeing operation and maintenance, improve the systems for grading energy efficiency and marking green buildings, strengthen the application of information technology and intelligent technologies, and make energy-saving and green transformation more planned. Standardize the behavior of building decoration, and effectively improve the level of building energy efficiency. It is suggested to supplement and improve the relevant content, specifically:


First, improve the energy consumption statistics and hierarchical management system, promote the installation of intelligent control equipment and facilities, and strengthen data analysis and application; Strengthen building energy consumption control, classify and determine energy consumption standards, and implement control measures at different levels. The second is to strengthen the management of green building signs, make it clear that new large public buildings with government funds participating in the investment and construction should apply for green building signs, and strengthen the operation and maintenance management of green buildings. The third is to strengthen departmental responsibilities, clarify that the housing urban and rural construction department is responsible for coordinating the green operation and maintenance management of buildings, strengthen the application of information, and promote the energy efficiency of existing buildings. The fourth is to standardize the decoration and decoration behavior, and a new provision stipulates that the decoration and decoration shall not damage the equipment and facilities related to green performance, and the property service personnel shall strengthen the inspection and supervision of the decoration and decoration activities. (Article 29 (2) of the second draft)


Fifth, strengthen energy-saving and green transformation, clarify that the municipal housing and urban and rural construction department is responsible for the overall coordination of transformation, organize the investigation, statistics and analysis, and formulate transformation plans; We will encourage energy-saving upgrading to be carried out in parallel with the upgrading of barrier-free and age-appropriate facilities. Fourth, strengthening scientific and technological support


Some members of the Standing Committee, deputies and relevant parties have pointed out that science and technology play an important supporting role in the green development of buildings, and it is necessary to comprehensively strengthen institutional supply, further improve the innovation system, clarify government responsibilities, strengthen personnel training, and strengthen technological research. It is suggested to supplement and improve the relevant content, specifically:


The first is to clarify the development direction, build a building technology innovation system that is in line with green orientation and ADAPTS to market demand, and create new technology application scenarios for green building development. (Article 35, paragraph 1, Second draft)


The second is to strengthen technological innovation, and a new provision stipulates that the municipal housing urban and rural construction, science and technology departments shall organize scientific and technological research around key technologies such as green building materials, green operation and maintenance, digital application, and building performance improvement. Third, promote the development of an innovation system, give full play to the role of enterprises, research institutions, institutions of higher learning, and scientific and technological innovators, support industry-university-research cooperation and international exchanges, promote the building of a technology research and development community, and build a platform for collaborative innovation. The fourth is to strengthen personnel training, strengthen the guidance and coordination of vocational training work, support the development of professional skills training, and promote the skills of practitioners. (Second reading draft Article 10, paragraph 2)


V. Industrial development and guidance and incentives


Some members of the Standing Committee, deputies and relevant parties have suggested that it is necessary to enrich guidance and incentive means, strengthen the application of evaluation results, fully mobilize the enthusiasm of market players, and promote high-quality industrial development. It is suggested to supplement and improve the relevant content, specifically:


First, promote the development of prefabricated buildings, and add a new article to encourage technology research and development and application, improve the quality of parts and components, promote the rational layout of production enterprises, and gradually establish a specialized, large-scale and information-based production system. The second is to improve the application of recycled products, promote the reduction of construction waste, resources, harmless, and implement the integration of construction demolition and construction waste transportation, storage, disposal, and use of recycled products. The third is to strengthen the evaluation and application of results, promote the evaluation of green buildings, prefabricated buildings, and healthy buildings, promote the demonstration of ultra-low energy consumption buildings and low-carbon buildings, and promote the application of relevant results in building value assessment and other aspects. In addition, on the basis of the deliberation views of the members of the Standing Committee and the views of various parties, some textual amendments have been made to the Bill and the order of some provisions has been adjusted.


In accordance with the above opinions, the Urban Construction and Environmental Protection Committee of the NPC proposed the Regulations on the Green Development of Buildings in Beijing (Second Reading Draft) and submitted them to this meeting of the Standing Committee for deliberation.

Chapter I General provisions


Article 1 In order to implement the concept of green development, save resources and energy, reduce pollutants and carbon emissions, improve building quality, improve living environment, and promote green, low-carbon and high-quality development in the field of construction, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual conditions of this Municipality.


Article 2 These Regulations shall apply to the planning, construction, operation and maintenance, renovation and demolition activities of civil and industrial buildings and the green development of related industries and their supervision and administration within the administrative areas of this Municipality.


Article 3 The green development of buildings in this Municipality shall follow the principles of Party committee leadership, government leadership, market operation and public participation, and adhere to whole-life management, whole-field promotion and whole-industry support.


Article 4 The green development of buildings in this Municipality shall comply with the following basic requirements:


(1) Adhere to the strategic positioning of the capital city, integrate with the protection of historic and cultural cities, urban renewal and other work, and connect with the construction of municipal infrastructure and resilient cities;


(b) adhere to the people-centered, improve the safety and durability of buildings, health and comfort, convenience and livable comprehensive performance, taking into account the applicability and economy of green and low-carbon technology applications;


(3) Adhere to the standard of the first good, actively take the lead in policy supply, technology application, industrial support and other aspects, and give play to the demonstration and leading role of the functional core area of the capital and the deputy urban center of Beijing;


(4) Adhere to the drive of scientific and technological innovation, encourage scientific and technological research and development, support industry-university-research cooperation, and stimulate market vitality;


(5) Adhere to regional coordination, strengthen green and low-carbon cooperation in the construction sector in the Beijing-Tianjin-Hebei region, and promote policy interaction and resource sharing.


Article 5 The municipal and district people's governments shall strengthen the organization, leadership and support for the green development of buildings, incorporate the green development of buildings into the national economic and social development plan, establish and improve the coordination mechanism for work, and study and solve the relevant major problems within their administrative areas.


Article 6 The relevant departments of the municipal and district people's governments shall implement the requirements for the green development of buildings in accordance with their duties.


The municipal Department of Housing and urban and rural construction is responsible for the overall planning, coordination, supervision and guidance of the relevant work of the municipality, organizing the preparation of the city's green building development plan and implementation plan, and studying and formulating relevant policies, standards and norms. The district housing and urban and rural construction department shall be responsible for the organization, coordination and supervision of relevant work within the administrative area, the preparation of implementation plans and the organization of implementation.


Development and reform departments implement relevant requirements in the supervision and administration of energy conservation, the utilization of renewable energy, and the approval and approval of fixed asset investment projects. The Planning and Natural Resources Department is responsible for the implementation of relevant requirements in the process of land supply, planning conditions, and design document monitoring. The city management department is responsible for promoting the implementation of relevant requirements in the field of power supply, gas supply and heating industry, and the supervision and management of construction waste disposal activities.


Departments of science and technology, economy and information technology, civil affairs, finance, ecological environment, water affairs, agriculture and rural areas, market supervision and administration, statistics, financial supervision and taxation shall be responsible for relevant supervision and administration in accordance with their respective duties. Education, transportation, commerce, culture and tourism, health, state-owned assets management, sports, landscaping, communications, radio and television and other departments, in accordance with their respective responsibilities to do a good job in the relevant work of the system.


Article 7 In the construction of new construction, reconstruction and expansion of construction projects, the construction unit shall bear the responsibility for construction in accordance with the requirements of green building development, and the design, construction, supervision and consulting units shall bear the corresponding responsibilities in accordance with the provisions and agreements.


The owner of the building undertakes the responsibility of green operation and energy-saving green transformation of the existing building. Where the building owner entrusts the property service person, the building user or any other unit or individual to manage, the trustee shall bear the corresponding responsibilities in accordance with the provisions and the agreement.


This Municipality strengthens engineering consultation in the whole process of construction projects, and the consulting units provide services in accordance with the agreement in project initiation, planning, design, construction, operation and maintenance, and transformation, and supervise the implementation of the requirements for green development of buildings.


Article 8 Citizens, legal persons and other organizations shall raise the awareness of environmental protection and sustainable development, actively participate in the practice of green development of buildings, and cultivate a simple, moderate, green and low-carbon way of production and life.


Relevant industry management departments and news media should strengthen the publicity of the green development of buildings, popularize relevant knowledge, and create a good social atmosphere.


Article 9 This Municipality shall, in accordance with the economic and social development and in combination with technological progress and the needs of the green development of buildings, formulate and promote local standards that are stricter than the national standards and industrial standards, encourage the formulation of group standards and enterprise standards, and improve standards and norms conducive to the green development of buildings.


Article 10 This Municipality supports scientific and technological innovation, encourages research, development, demonstration and promotion of new green and low-carbon technologies, new processes, new materials and new equipment, and promotes the green development of construction-related industries.


The City strengthens the guidance and coordination of vocational training work, supports enterprises, scientific research institutions, colleges and universities, and industry associations to carry out professional skills training, and promotes the skills improvement of practitioners in the green development of construction.


Article 11 This Municipality, Tianjin Municipality and Hebei Province improve the work coordination mechanism, promote the coordination of technical standards, mutual recognition of certification results, supervision and law enforcement linkage, credit information sharing, and promote the coordinated development of related industries.


Chapter II Planning and construction


Article 12 The municipal housing and urban and rural construction department shall, in conjunction with the development and reform, planning of natural resources, urban management and other relevant departments, organize the preparation of building green development plans, clarify the development objectives, main tasks and safeguard measures, and announce the implementation after approval by the municipal people's Government.


Article 13 The relevant contents of the municipal green development plan for buildings shall be incorporated into the corresponding level of national space planning.


Construction land planning conditions should be clear green building grade, prefabricated building requirements, ultra-low energy consumption buildings and renewable energy application requirements, and as a part of the state-owned land use right transfer contract or state-owned land allocation decision.


Article 14 New civil buildings shall comply with the standard of one-star green building or above; New large public buildings, new civil buildings invested by government funds, and new residential buildings in urban sub-centers shall comply with the two-star standard of green buildings and above; New super high-rise buildings, new buildings in the functional core area of the capital and new public buildings in the sub-center of the city implement the three-star standard for green buildings. Encourage the construction of industrial buildings in accordance with the standard of green buildings with a star or above.


New civil buildings and industrial buildings shall be constructed by prefabricated buildings in accordance with the regulations of this Municipality, and the proportion of prefabricated buildings in new buildings and the degree of assembly of building monomer shall be gradually increased.


The Municipality promotes ultra-low energy consumption buildings, explores ways to promote the implementation of ultra-low energy consumption building standards for new public buildings invested with government funds, and encourages the construction of new commercial housing in accordance with ultra-low energy consumption building standards.


The municipal and district department of housing and urban and rural construction shall, together with relevant departments, in accordance with the objectives and tasks set out in the plan for green building development, timely raise the requirements for green development of the whole city or some regions and some types of new buildings, which shall be implemented after approval by the people's government at the same level.


The specific standards for green buildings, prefabricated buildings and ultra-low energy consumption buildings shall be implemented in accordance with the relevant regulations of the State and this Municipality.


Article 15 This Municipality promotes the large-scale application of renewable energy in buildings. New buildings shall be installed in accordance with the standards of solar photovoltaic or solar thermal systems. Renewable energy utilization facilities of new buildings shall be coordinated with the appearance and form of the building, synchronized design, construction and acceptance with the main body of the building, and ensure normal application.


Power grid enterprises should support renewable energy building applications such as distributed photovoltaic power generation, and enhance renewable energy consumption and Internet access capabilities.


Article 16 This Municipality promotes the use of safe and durable, energy-saving and low-carbon, excellent performance, health and environmental protection building materials and equipment and facilities. The Municipal Department of Housing and urban and rural construction shall, together with relevant departments, formulate, publish and timely update the list of construction technologies, processes, materials and equipment prohibited by this Municipality, and conduct fair competition review according to law. The compilation and revision procedures of the catalogue shall follow the principle of scientific demonstration and public participation.


Construction, design and construction units shall not use the technologies, techniques, materials and equipment listed in the prohibited list in construction activities, and supervision units shall incorporate relevant requirements into Article 17 This Municipality shall implement a special green management system for construction projects. In the construction project formulation, planning, design, construction, supervision should be prepared green special sections, clear green building grade, prefabricated building requirements, ultra-low energy consumption building performance, renewable energy and green building materials application, technical path, energy saving and emission reduction benefits and other related content.


The specific requirements for the preparation of green sections shall be separately formulated by the municipal Department of housing and urban and rural construction together with relevant departments.


Article 18 The construction unit shall incorporate the green section into the project proposal, feasibility study report, project application report and design plan and other design documents, and specify the relevant construction costs and funding sources in the documents.


Design, construction and supervision units shall respectively incorporate the green section into the project design document, construction organization design, supervision implementation rules or plans, and carry out relevant activities in accordance with the requirements of the green section.


If the supervision unit finds that the construction unit does not carry out construction in accordance with the requirements of the green section and the standards and specifications, it shall require the construction unit to correct; If the construction unit refuses to make corrections, the supervision unit shall promptly report the relevant situation to the construction unit and report to the relevant competent department according to law.


Article 19 Development and reform departments shall, in accordance with their duties, incorporate the requirements for green development of buildings into the examination and approval of fixed assets investment projects.


The planning department of natural resources shall supervise the implementation of the green development requirements of buildings in the management of design documents.


The housing and urban and rural construction departments shall supervise and manage the implementation of building green development requirements in the construction process according to their duties.


Article 20 The construction unit shall organize the design, construction, supervision and other relevant units to check and accept the implementation of the green development requirements in the construction land planning conditions. Where the acceptance check is not carried out or fails to pass the acceptance check, the acceptance report shall not be issued.


The housing and urban and rural construction departments shall refine the acceptance specifications and strengthen guidance and supervision.


Article 21 When a building construction project is delivered for use, a construction unit shall specify in the building construction quality guarantee certificate the relevant indicators of green development of the building, specify the warranty scope, period and other quality warranty responsibilities and liabilities for breach of contract. In the instructions for the use of building construction, the standards, green environmental protection performance, green technology measures, the list of facilities and equipment and the instructions for use, the requirements for use and maintenance, and the prohibited items are clearly defined.


Real estate development enterprises shall specify green building grades, prefabricated building requirements, building energy efficiency standards and renewable energy applications in the sales site, house sales contracts and house inspection guidelines.


Article 22 This Municipality actively promotes the construction of green farm houses, prefabricated farm houses and ultra-low energy consumption farm houses, promotes the application of renewable energy and green building materials in rural areas, and guides the construction of livable houses with modern functions, safe structure, economical cost, green environmental protection and coordination with rural environment.


Low-rise houses built by farmers themselves are encouraged to be built in accordance with the provisions on earthquake fortification and design standards for energy conservation and carbon reduction. The construction projects that apply for the implementation of the policy support for the construction of new seismic and energy-saving agricultural houses shall meet the relevant requirements for the green development of buildings in this Municipality.


Construction projects that enjoy policy support, such as renovation of dilapidated rural houses, relocation of migrants, post-disaster recovery and reconstruction, shall meet the relevant requirements for the green development of buildings in this Municipality.


(1) The operation and maintenance system is complete, and the designated person is clearly responsible;


(2) Exercising indoor temperature control in accordance with State regulations;


(C) heating, ventilation, air conditioning, lighting, water and other equipment and facilities and their automatic monitoring systems, building energy consumption water consumption measurement system is running normally;


(4) other requirements prescribed by the State and this municipality.


Article 31 This Municipality shall, in accordance with geographical and climatic conditions and economic and social development, orderly promote the energy-saving and green transformation of existing buildings and improve the comprehensive performance of buildings.


The municipal Department of Housing and urban and rural construction is responsible for the overall coordination of the energy-saving and green transformation of the existing buildings in this city, organizing the investigation and statistics and analysis, formulating the transformation plan, and timely adjusting the scope and standards of the transformation.


Municipal government affairs management, education, commerce, culture and tourism, health, state-owned assets management and other departments shall formulate the system of energy conservation and green transformation work plan.


The district people's governments shall be responsible for the organization and implementation of the energy-saving and green renovation of existing buildings within their respective administrative areas.


Article 32 The implementation of urban renewal projects shall carry out energy-saving and green transformation of existing buildings.


When the existing public buildings are rebuilt, expanded and decorated externally, corresponding energy-saving and green transformation shall be carried out simultaneously.


On the basis of respecting the will of the building owner, the existing residential buildings can be implemented to improve building energy efficiency and green, and encourage the implementation of the renovation of professional pipelines such as water, electricity, gas and heat in the building, the renovation of barrier-free and age-appropriate facilities and the improvement of the environment in public areas.


Article 33 The implementation of energy conservation and green transformation of existing buildings shall be encouraged to implement in accordance with the standards of green buildings or ultra-low energy consumption buildings, and the addition of renewable energy utilization facilities shall be encouraged.


We will encourage professional operation and maintenance methods such as contract energy management to organize the implementation of energy-saving green renovation of existing buildings and promote the application of renewable energy.


Article 34 This Municipality promotes the green demolition of buildings. When the building is dismantled, the construction unit or other demolition units shall formulate construction waste treatment plans, clarify the disposal methods and cleaning measures, and urge the construction unit to take green construction measures such as dust control.


The construction unit shall prepare the construction waste treatment plan of the construction site, and adopt green construction measures such as dust control in accordance with the standards and regulations.


Chapter IV Science and technology and industrial support


Article 35 This Municipality supports research on building science and technology, builds a building technology innovation system that is in line with green orientation and ADAPTS to market demand, and creates application scenarios of new technologies for green building development.


The municipal housing and urban and rural construction, science and technology departments shall promote technological innovation, organize and carry out scientific and technological research on key technologies such as green building materials, intelligent construction, building industrialization, renewable energy application, green building operation and maintenance, digital application, and building performance improvement.


Article 36 Municipal housing urban-rural construction, science and technology departments should strengthen the construction of scientific and technological innovation system, give full play to the role of enterprises, scientific research institutions, universities and scientific and technological innovation personnel, support cross-industry, cross-field, cross-regional cooperation and international exchanges, support the construction industry chain upstream and downstream related enterprises to form a technology research and development community, to create a collaborative innovation platform.


This Municipality has established an expert committee system for building green development to provide argumentation and advice for activities related to building green development.


Article 37 This Municipality promotes the coordinated development of intelligent construction and new-type building industrialization, and forms an intelligent building industrial system covering the whole industrial chain of scientific research, design, production and processing, construction and assembly, operation and service.


This Municipality encourages roads, Bridges, rail transit, integrated pipe corridors and other municipal infrastructure to adopt green building materials and prefabricated construction methods, and apply building information modeling technology.


Article 38 This Municipality promotes the improvement of the scientific and technological level and engineering quality of prefabricated buildings, and raises the level of standardized design, factory production, assembly construction, integrated decoration, information management and intelligent application.


This Municipality encourages and guides the research, development and application of technologies and equipment suitable for prefabricated buildings, improves the quality of prefabricated components and parts, and improves building performance.


The city promotes the rational layout of prefabricated building-related production enterprises in the Beijing-Tianjin-Hebei region, and gradually establishes a specialized, large-scale and information-based production system.


Article 39 This Municipality promotes the construction of green supply chain of building materials, cultivates integrated supply enterprises of building materials, and encourages green production, green packaging, green transportation, recycling and utilization of waste products to achieve green environmental protection of the whole chain of building materials supply.


The city has established and improved the traceability supervision and management system of building materials supply chain, implemented the classification standard and coding of building materials data, and identified building materials products.


Article 40 This Municipality promotes the certification of green building materials and the acceptance of the results, timely publicity, regular release of product information and application, and gradually improve the application proportion of green building materials.


Construction projects in which government funds participate in investment and construction shall give priority to the procurement and use of green building materials, and encourage other construction projects to give priority to the use of green building materials.


Article 41 This Municipality promotes the reduction, recycling and harmless of construction waste, implements the integrated implementation of construction demolition and construction waste transportation, collection and storage, disposal and use of recycled products, and the disposal costs shall be included in the construction project budget.


Government funds to participate in the investment of construction projects should be in accordance with the construction waste recycling products in the relevant requirements of the project site, encourage other construction projects to give priority to the selection of recycled products.


Article 42 This Municipality strengthens the information construction of green building development. Municipal housing and urban and rural construction departments rely on smart city information construction common basic platform, improve construction engineering supervision and housing management platform, explore the building number plate system, integrate building life cycle information, and promote the realization of data collection and information interconnection.


Article 43 This Municipality shall strengthen policy guidance and promote the application of new construction organization models such as general contracting of housing construction projects and architect responsibility system in the green development of buildings.


Article 44 This Municipality promotes the green development of municipal public utilities, gradually improves the capacity of green power supply and consumption, promotes the use of new energy, renewable energy and waste heat for heating, and promotes the electrification and intellectualization of building energy.


Article 45 This Municipality promotes the construction of national green development demonstration zones such as urban sub-centers, carries out the creation of green communities, builds a green and low-carbon comprehensive energy system, and promotes near-zero carbon emission demonstration.


Chapter Five guide and motivate


Article 46 This Municipality shall adopt the following supporting policies for the green development of buildings:


(1) Projects that take the initiative to improve the grade standards of green buildings, voluntarily implement prefabricated buildings or improve the grade of prefabricated buildings, and actively implement ultra-low energy consumption buildings shall be given priority in the evaluation of various construction projects awards;


(2) Individuals using housing provident fund loans to purchase two-star or above green buildings, prefabricated buildings or ultra-low energy consumption buildings can be given appropriate policy support, specific measures by the housing provident fund management department;


(3) Commendation and awards shall be given to outstanding parks, outstanding projects, advanced units and individuals in activities related to the green development of buildings in accordance with the relevant regulations of the State and this Municipality.


Article 47 This Municipality improves the credit management system for building green development, and implements incentives to keep faith and punishments for breaking faith according to law.


Article 48 This Municipality shall strengthen the evaluation of green buildings, gradually implement the evaluation system of prefabricated buildings and healthy buildings, promote the demonstration of projects such as ultra-low energy consumption buildings and low-carbon buildings, and promote the application of relevant results in the evaluation of building values and other aspects.


This Municipality encourages the exploration and establishment of green evaluation standards in the construction of municipal infrastructure such as roads and Bridges, and clarifies grade requirements.


Article 49 This Municipality encourages the development of demonstration projects in key functional areas, industrial parks and areas that implement urban renewal, so as to enhance the scale and agglomeration benefits of green building development.


Article 50 The municipal and district people's governments may strengthen the overall planning of funds and provide financial support in the research and development, demonstration and promotion of green building development technologies, energy saving and green transformation of existing buildings, development and utilization of renewable energy, and construction of green ecological demonstration zones.


Article 51 This Municipality encourages financial institutions to provide green credit, green insurance, green bonds, green funds and other services around the construction green development industry chain, and strengthen the supply of green financial products.


Article 52 This Municipality improves the construction sector's participation in the municipal carbon emission rights trading mechanism, and promotes differentiated energy price management.


Article 53 This Municipality shall establish and improve the service system for the green development of buildings, and support industry associations, societies and third-party institutions to provide services in terms of technology promotion, information consultation, publicity and training, market expansion, rights and interests protection, operation and maintenance evaluation and other aspects for market entities.


The trade association shall strengthen the self-discipline of the industry, carry out the education and training of practitioners, and guide the member units and practitioners to carry out activities related to the green development of construction in accordance with the law.


Chapter VI Legal liability


Article 54 Where a construction, design or construction unit, in violation of the provisions of paragraph 2 of Article 16 of these Regulations, uses the construction techniques, techniques, materials and equipment listed in the list of prohibited uses, the department for housing and urban and rural construction, planning of natural resources and other departments shall, in accordance with their duties, order corrections within a time limit, and impose a fine of not less than 200,000 but not more than 500,000 on the construction unit. A fine of not less than 100,000 but not more than 300,000 yuan shall be imposed on the designing unit and not less than 100,000 but not more than 200,000 yuan shall be imposed on the construction unit; If the circumstances are serious, the department that issued the qualification certificate shall order it to suspend business for rectification, reduce the qualification level or revoke the qualification certificate.


Article 55 In violation of the provisions of paragraph 1 of Article 17 of these Regulations, the construction, design, construction or supervision unit fails to prepare a green section in accordance with the provisions, the housing and urban and rural construction, planning and natural resources and other departments shall order corrections within a time limit, fail to make corrections within the time limit, and shall be imposed a fine of not less than 50,000 yuan but not more than 100,000 yuan.


Article 56 In violation of the provisions of the first paragraph of Article 20 of these Regulations, the construction unit fails to organize the acceptance inspection in accordance with the provisions, or fails to pass the acceptance inspection and issue the completion inspection report, the housing and urban and rural construction department shall order correction and impose a fine of not less than 2 percent but not more than 4 percent of the project contract price.


Article 57 In violation of the provisions of Article 21 of these Regulations, the construction unit fails to specify the relevant contents in the building quality guarantee certificate and the use manual, or the real estate development enterprise fails to specify the relevant contents in the commercial housing sales site, the housing sales contract and the house inspection guide, the housing urban and rural construction department shall order the correction within a time limit, and if the correction is not made within the time limit, a fine of not less than 30,000 yuan but not more than 50,000 yuan shall be imposed.


Article 58 Where, in violation of the provisions of paragraph 3 of Article 24 of these Regulations, units of power supply, gas supply, heat supply and water supply fail to submit settlement data in accordance with the provisions, the urban management comprehensive administrative law enforcement and water affairs departments shall, in accordance with their duties, order corrections within a time limit, and give a warning if corrections are not made within the time limit.


Article 59 Where, in violation of the provisions of the first paragraph of Article 25 of these Regulations, the energy consumption of large public buildings exceeds the constraint value of the municipal public building energy consumption standards by more than 80% for two consecutive years and fails to implement energy-saving green transformation in accordance with the provisions, the housing and urban and rural construction department shall order corrections within a time limit, and if corrections are not made within the time limit, a fine of not less than 30,000 yuan but not more than 100,000 yuan shall be imposed.


Article 60 Where, in violation of the provisions of the first paragraph of Article 29 of these Regulations, the building owner or the entrusted manager arbitrarily demolishes or damages the equipment and facilities related to the green performance of the building, the housing and urban and rural construction department shall order it to make corrections, and if it fails to make corrections within the time limit, it shall be imposed a fine of not less than 1,000 yuan but not more than 10,000 yuan.


Chapter VII Supplementary Provisions


Article 61 The green development of municipal infrastructure in the administrative area of this Municipality shall be governed by reference to these Regulations, explore the establishment of green evaluation standards, give priority to the procurement and use of green building materials and construction waste recycling products, promote the application of prefabricated construction technology, and gradually improve operational efficiency.


Article 62 These Regulations shall go into effect as of the date of the year.

Chapter three: Operation, maintenance and transformation


Article 23 This Municipality promotes green, fine and intelligent operation and maintenance of buildings, and reduces resource and energy consumption, pollutant emission and carbon emission.


Article 24 This Municipality shall improve the statistical system of energy and resources consumption in civil buildings, promote the installation of metering and intelligent control equipment and facilities for electricity, gas, heat and water by classification, division and item, standardize data submission, and strengthen data analysis and application.


The owners or trustees of residential buildings and public buildings included in the statistical objects of energy and resources consumption shall, in accordance with regulations, submit the data of electricity, gas, heat and water consumption corresponding to the buildings.


Units of power supply, gas supply, heat supply and water supply shall, in accordance with regulations, submit settlement data of electricity, gas, heat and water consumption corresponding to residential buildings and public buildings included in the statistical objects of energy and resources consumption.


The specific measures for reporting the data of energy and resources consumption in civil buildings shall be formulated by the municipal department of housing and urban and rural construction in conjunction with the departments of statistics, development and reform, urban management, water affairs and ecological environment.


Article 25 This Municipality establishes a graded management system for energy efficiency of public buildings to determine energy consumption standards by classification. If the annual energy consumption exceeds the constraint value of the standard, the owner of the building shall strengthen the management of energy-saving operation; If the annual energy usage exceeds 80% of the standard constraint value, the building owner shall carry out energy audit at the same time; Where the energy used exceeds the standard constraint value by more than 80% for two consecutive years, the owner of the building shall implement energy-saving green transformation in accordance with the provisions.


The municipal housing and urban and rural construction department, together with the municipal development and reform departments, regularly announces to the public the public buildings with energy efficiency demonstration roles and their owners and operation and management units.


The specific measures for the graded management of energy efficiency of public buildings shall be formulated by the municipal Department of housing and urban and rural construction together with the development and reform departments.


Article 26 This Municipality implements the green building marking system. New large public buildings with government funds participating in the investment and construction shall apply for green building marking, and other new buildings shall be encouraged to apply for green building marking. The owner of a green building shall express a green building sign in a prominent position on the facade of the building to strengthen operation and maintenance management.


Article 27 The housing urban and rural construction department is responsible for coordinating and promoting the green operation and maintenance management of buildings and promoting the energy efficiency of existing buildings.


Departments such as housing and urban and rural construction should strengthen the application of information, promote data sharing and information disclosure, and improve the efficiency of management services.


Article 28 The owner of a building shall bear the responsibility for the green operation and maintenance of the building and shall abide by the relevant laws and regulations on the conservation and utilization of resources and energy to ensure the safe and stable operation of the building.


For buildings that have implemented property management, the property service person shall bear the responsibility for building green operation and maintenance in accordance with the provisions and agreements.


Article 29 The building owner or the entrusted manager shall not arbitrarily dismantle or damage the insulation layer of the building envelope, renewable energy system, energy consumption measurement system, ventilation system and other equipment and facilities related to the green performance of the building.


The decoration of the building shall not damage the equipment and facilities related to the green performance of the building. Property service personnel shall strengthen the inspection and supervision of decoration activities.


Article 30 The operation and maintenance of public buildings shall meet the following requirements:
