The Beijing Municipal Regulations on Green Development of Buildings will come into effect from March next year

Recently, the 6th meeting of the 16th Standing Committee of the Beijing Municipal People's Congress voted to pass the Beijing Municipal Regulations on Green Development of Buildings (hereinafter referred to as the "Regulations"). The regulations consist of 7 chapters and 61 articles, including general principles, planning and construction, technology and industry support, guidance and incentives, legal responsibilities, etc., aimed at implementing the concept of green development, conserving resources and energy, reducing pollution and carbon emissions, improving building quality, improving living environment, and promoting green, low-carbon, and high-quality development in the construction field. The regulations will come into effect on March 1st next year.

The regulations specify the responsibility requirements for building operation, maintenance, and renovation, and the building owner bears the responsibility for green operation, maintenance and management to ensure the safe and stable operation of the building. Establish and improve a statistical system for energy resource consumption in civil buildings and a graded management system for energy efficiency in public buildings; Implement a green building identification system, and new large-scale public buildings invested and constructed by government funds should apply for green building identification; Promote the energy-saving and green renovation of existing buildings in an orderly manner, connect them with urban renewal projects, and encourage synchronous implementation with the renovation of professional pipelines such as water, electricity, gas, and heat inside buildings, while respecting the wishes of building owners; Promote the green demolition of buildings and implement the responsibility of building waste disposal.

The regulation proposes that new civil buildings in Beijing shall comply with the standard of one star or above for green buildings; Newly built large-scale public buildings, civil buildings invested and constructed by government funds, and residential buildings in urban sub centers shall comply with the green building two star or above standards; Newly built super high-rise buildings, buildings in the core functional area of the capital, and public buildings in the urban sub center shall comply with the three-star green building standard.

At the same time, real estate development enterprises should clearly indicate the green building level, prefabricated building requirements, building energy efficiency standards, and renewable energy applications in the sales site, housing sales contracts, and inspection guidelines. In addition, Beijing will also promote ultra-low energy buildings and prioritize the implementation of ultra-low energy building standards for new public buildings invested and constructed with government funds.

According to regulations, individuals who use housing provident fund loans to purchase green buildings, prefabricated buildings, or ultra-low energy buildings with a rating of two stars or above can receive appropriate policy support.

Beijing will establish a graded management system for energy efficiency of public buildings. If the annual energy consumption exceeds the standard constraint value, the owner of public buildings should strengthen energy-saving operation management; If it exceeds 80% of the standard constraint value, the building owner shall conduct energy audits simultaneously; If the energy consumption exceeds 80% of the standard constraint value for two consecutive years, the building owner shall implement energy-saving and green transformation in accordance with regulations.
