Recently, the sixth meeting of the Standing Committee of the 14th National People's Congress of Hubei Province voted through the "Regulations on the Development of Green Buildings in Hubei Province" (hereinafter referred to as the "Regulations"), the "Regulations" will be implemented on March 1, 2024, and green buildings in our province will usher in a historic opportunity for development.

In recent years, under the strong leadership of the provincial Party Committee and the provincial government, the province has continued to carry out green building actions and vigorously promote the development of green buildings. During the "13th Five-Year Plan" period, green buildings accounted for more than 70% of the new residential buildings in the province. By the end of 2022, a total of 969 projects with a total floor area of about 113 million square meters had been awarded the green building designation.

The formulation and introduction of the "Regulations" will fundamentally solve the problems existing in the development of green buildings in the past, such as weak policy constraint, insufficient execution, and lack of regulatory means, and provide a strong legal guarantee for the realization of the work goal of "fully building green buildings in new civil buildings in cities and towns by 2025".

The drafting process and main contents of the Ordinance

The Provincial Department of Housing and Construction began to organize the drafting of the Regulations in 2022, and on the basis of full research and demonstration, repeated solicitations for opinions, and repeated modifications and improvements, the draft Regulations were finally formed. The executive meeting of the provincial government conducted thematic deliberations on the draft Regulations, and the Standing Committee of the Provincial People's Congress deliberated and passed three times.

The Regulations have a total of 6 chapters and 43 articles, which are divided into general provisions, planning and construction, operation and renovation, technology application and incentive measures, legal responsibilities, supplementary provisions and other contents, and are applicable to the planning, construction, operation, renovation and supervision and management activities of green buildings in the administrative areas of this province.

The Regulations make it clear that people's governments at or above the county level should strengthen leadership over the development of green buildings; The competent housing and urban and rural construction departments at all levels shall be responsible for the guidance, supervision and administration of green building development and related activities within their respective administrative areas; Development and reform, natural resources, finance, economy and information technology departments above the county level shall do a good job in green building development according to their respective responsibilities.

The Regulations put forward specific requirements for green building planning, stipulating that "the competent department of natural resources of the people's government at or above the county level shall clarify the green building grade requirements in the construction land planning conditions, and incorporate the green building grade requirements into the scope of construction project planning review."

The Regulations also put forward detailed requirements for green building grades, stipulating that "new civil buildings in cities and towns shall fully implement green building standards and be constructed in accordance with the requirements of green building basic level and above." The newly built government-subsidized housing shall be constructed in accordance with the requirement of no less than one star of green building; Guide real estate projects to be built in accordance with the requirements of no less than one star green building. New state organ office buildings, large public buildings, state-owned funds to participate in the construction of public welfare buildings should be built in accordance with the requirements of not less than the two-star green building."

The Regulations have made clear provisions on the responsibility, operation management, green transformation of each participant in the construction of green buildings, as well as the incentive and support policies for the development of green buildings, and the penalties for violations of laws and regulations of each responsible subject.
