The Administrative Measures for Green Buildings in Zhuhai Special Economic Zone have been deliberated and adopted at the 47th Executive Meeting of the 10th Zhuhai Municipal People's Government on November 29, 2023, and are hereby promulgated and shall come into force on January 14, 2024.

Measures for the Administration of green buildings in Zhuhai Special Economic Zone


Chapter I General rules


Article 1 These Measures are formulated in accordance with the basic principles of relevant laws and administrative regulations and in light of the actual conditions of Zhuhai Special Economic Zone in order to implement the new development concept, improve the low-carbon green level of buildings, regulate green building activities, save resources, improve the quality of human settlements and promote the construction of an ecological civilization city.


Article 2 These Measures shall apply to the planning, construction, operation, renovation, demolition and supervision and administration of green buildings within the administrative areas of this Municipality.


The term "green building" as mentioned in these Measures refers to high-quality civil buildings that save land, water, energy, building materials and other resources, protect the environment, reduce pollution, provide people with healthy, applicable and efficient use of space, and realize harmonious coexistence between man and nature during the whole life of the building.


Article 3 This city shall implement the new development concept, build a new development pattern, promote the transformation and upgrading of green, industrialized, digital, intelligent and low-carbon buildings, promote the coordinated development of intelligent construction and building industrialization, explore the integrated development of building and cutting-edge technologies such as the Internet of Things, cloud computing and artificial intelligence, and strive to promote the high-quality development of the construction industry.


Article 4 The municipal and district people's governments (hereinafter referred to as the municipal and district governments) shall incorporate the development of green buildings into the national economic and social development planning, coordinate the major issues of the development of green buildings under their jurisdiction, formulate corresponding policies and measures, clarify the development goals, and take the completion of the goals as the content of government assessment.


The management organization of the economic functional zone shall fulfill the responsibilities of the district government to promote the development of green buildings.


Article 5 The municipal and district administrative department of housing urban and rural construction is the administrative department in charge of green building work in this Municipality, responsible for organizing the implementation of these Measures, and carrying out the supervision, management and publicity of green building development and related activities.


Development and reform, natural resources, ecological environment, urban management comprehensive law enforcement, finance and other administrative departments, in accordance with their respective responsibilities to do a good job in green building development related work.


Article 6 Municipal and district governments shall provide financial guarantee for promoting the development of green buildings, make full use of special funds for pollution control, energy conservation and carbon reduction, and guide social capital to invest in and operate green buildings.


Specific measures for funding security shall be formulated separately by the municipal and district governments.


Article 7 The municipal administrative department of housing urban and rural construction shall establish a trustworthy incentive mechanism and a punishment mechanism for dishonesty according to law, and carry out dynamic evaluation and management of the credit situation of enterprises.


Encourage green building related industry associations to establish industry conventions, promote industry self-discipline, and promote the development of industry norms.


Chapter II Planning and construction


Article 8 The competent administrative department of housing urban and rural construction shall, together with the competent administrative departments of development and reform and natural resources, organize the preparation of special plans for the development of green buildings, submit them to the governments at the same level for approval and make them public.


Article 9 When examining and approving green building projects constructed with fiscal funds, the administrative departments for development and reform and the administrative departments for finance shall ensure the input of incremental costs and green construction expenses of green building projects in accordance with the requirements of green building construction standards and indicators.


If the green building 1-star or above project using fiscal funds fails to pass the green building evaluation or fails to obtain the green building mark, the incremental cost of the green building shall be reduced when the project is settled.


If a construction project using a new type of industrial construction such as prefabricated construction with financial funds has not implemented a new type of industrial construction such as prefabricated construction, the incremental cost of the new type of industrial construction such as prefabricated construction shall be reduced at the time of project settlement.


Article 10 The competent department of natural resources administration shall incorporate the relevant contents of the special planning for the development of green buildings into the detailed planning, and according to the detailed planning, the relevant requirements for the industrial construction methods of green buildings, prefabricated buildings and other new buildings into the planning conditions of state-owned construction land.


The competent department of natural resources administration shall indicate in the contract for the assignment of the right to the use of state-owned construction land or the decision on the allocation of state-owned land, as well as the construction project planning license the requirements for the grade of green buildings and the relevant requirements for the new industrial construction methods of prefabricated buildings.


Article 11 New civil buildings in this municipality shall be constructed in accordance with the green building standards. The green building standards shall be formulated separately by the municipal administrative department of housing and urban and rural construction.


Article 12 Where the conditions of land use planning require the construction of new industrial construction methods such as prefabricated buildings, the new houses shall be implemented in accordance with the requirements. The specific scope of implementation shall be formulated separately by the municipal administrative department of housing and urban and rural construction.


Article 13 A construction unit shall carry out construction in accordance with the requirements for the grade of green building indicated in the construction project planning license and the requirements for the construction of new industrial construction methods such as prefabricated buildings.


The construction unit shall strengthen the quality management of the whole process of green building construction and assume the responsibility of project quality management of the construction unit. The feasibility study report or project application report of a new civil building project shall contain a special section on green buildings, which shall specify the green building grade, technology, energy conservation and emission reduction targets, and the contents of new industrial construction methods such as prefabricated buildings, etc., and include the relevant costs of construction of new industrial construction methods such as green buildings and prefabricated buildings into the project investment estimate and budget estimate.


When a construction unit entrusts the design, construction and supervision of a new civil building project, it shall specify the grade of green building in the contract. The construction unit shall not explicitly or imply that the entrusted unit violates the green building standards in the design, construction and supervision of the project.


Where a new civil building project shall be subject to design bidding according to law, the tenderer shall specify the green building grade of the project in the design bidding documents.


Where a construction unit entrusts a third-party consulting institution to provide green building consulting services, the consulting institution shall be responsible for the authenticity of the consulting report or materials.

Where the construction drawing design document changes the grade of green building and the construction requirements of new industrial construction methods such as prefabricated building, it shall be re-examined.

The construction unit and the design, construction and supervision unit shall bear the quality responsibility of the construction project of green building and the implementation of new industrial construction methods such as prefabricated building according to law.


Article 17 For construction projects included in the scope of construction implementation of new industrial construction methods such as prefabricated buildings in accordance with regulations, the construction unit shall, after obtaining the land planning license (or having a clear document of planning conditions) and completing the preliminary design of the project, the municipal administrative department of housing urban and rural construction shall carry out technical certification of the architectural design stage of new industrial construction methods such as prefabricated buildings.


Article 18 A prefabricated component manufacturing enterprise shall establish a component quality inspection and acceptance system. Inspection and acceptance of component quality and concealed acceptance shall form acceptance records and retain image data; Quality control and inspection data shall be complete, true and traceable. The prefabricated component can be mass-produced only after the first piece is accepted.


The prefabricated components that pass the inspection shall be uniquely identified (such as two-dimensional code, etc.), and the identification contents include: production unit, project name, component model, component number, production date, factory date, etc. The components with incomplete identification shall not leave the factory, and complete quality certification documents shall be provided when the components are delivered for use.


Article 19 The construction unit shall be responsible for organizing investigation, design, production, construction, supervision and other units and relevant experts to form an inspection group to conduct joint acceptance inspection of the first batch of components and the first batch of standard layers of the new industrial construction mode of prefabricated buildings, etc. The units and personnel participating in the acceptance inspection shall sign and seal the acceptance opinions.


20th project quality testing institutions shall be in accordance with the construction project quality management requirements and relevant standards, green building project quality testing.


Article 21 Real estate development enterprises shall truthfully state the green building grade and main technical measures of the houses sold in the sales contract of green building commercial houses, the residential quality guarantee certificate and the residential operation manual, and clarify the quality warranty responsibility. When selling commercial housing, the green building grade shall be clearly stated at the sales site.


Chapter Three operation and transformation


Article 22 The operation of green buildings shall meet the following requirements:


(1) Complete operation and management system;


(2) The roof, external walls, external doors and Windows and other building enclosures are intact, and the facilities and equipment such as shading are in normal operation;


(3) Ventilation, air conditioning, lighting, water, electrical and other equipment systems operate normally;


(4) The energy-saving and water-saving indicators shall comply with the provisions of the State, Guangdong Province and this Municipality;


(5) indoor temperature and humidity, noise, air quality and other environmental indicators meet the standards;


(6) The discharge and disposal of waste gas, sewage, solid waste, radiation and other harmful substances shall comply with the provisions of the State, Guangdong Province and this Municipality.


Article 23 The competent administrative department of housing urban and rural construction shall, together with the competent department of energy conservation at the same level, establish and improve the system of building energy consumption statistics, energy auditing, energy consumption monitoring and energy efficiency evaluation, so as to provide a basis for scientific and efficient supervision of green building operation, building energy management, energy saving transformation and carbon emission trading.


Power supply, gas supply, water supply and other units shall provide building energy and water resources consumption data to the local housing urban and rural construction administrative departments.


Building owners, users and property service enterprises shall provide convenient conditions for building energy consumption statistics, energy auditing and energy consumption monitoring, ensure the normal operation of energy consumption sub-metering devices, and steadily transmit relevant energy consumption data to the municipal building energy consumption monitoring platform as required.


Article 24 The municipal and district governments shall promote the green transformation of existing civil buildings.


Existing large public buildings and state organ office buildings, state-owned funds to participate in the investment and construction of other public buildings after assessment do not meet the corresponding green building standards, should be prioritized into the green transformation plan.


Green transformation should be carried out simultaneously in urban renewal.


The cost of green renovation of office buildings of administrative institutions shall be solved in accordance with the current funding guarantee channels. Encourage building energy efficiency service institutions to provide contract energy management services for building operation and green transformation of existing civil buildings.


Article 25 The house demolition project shall implement the integrated management of house demolition, comprehensive utilization of construction waste and clearing and transportation.


Encourage house demolition projects with comprehensive utilization conditions to carry out comprehensive utilization on site. If the site cannot be comprehensively utilized, it shall be transported to the construction waste disposal site for disposal.


Article 26 Office buildings of government organs and institutions, large public buildings and new civil buildings that comply with the green building standards of more than two stars shall install energy consumption metering devices such as electricity and natural gas, and establish real-time monitoring systems for building energy consumption.


Where the buildings mentioned in the preceding paragraph are newly built, the construction of the energy consumption monitoring system shall be integrated with the design of the main body of the building, and the construction and acceptance shall be synchronized.


Article 27 The municipal administrative department of housing urban and rural construction shall formulate the municipal carbon emission control targets in the field of construction, and gradually establish systems and mechanisms such as building carbon statistics, carbon auditing, carbon monitoring and carbon publicity in conjunction with relevant departments to promote the realization of carbon neutrality in the field of construction.


Article 28 The municipal administrative department of housing urban and rural construction shall, together with the municipal administrative departments of development and reform, statistics and ecological environment, comprehensively determine and publish the list of key carbon emission buildings, and determine the energy consumption and carbon emission baseline of different types of buildings according to the conditions of building functions, carbon emission and geographical location.


The municipal ecological environment administrative department shall, in accordance with the relevant work deployment of the national and provincial carbon emission rights trading, be responsible for cooperating with the provincial ecological environment administrative department to organize the carbon emission information reporting and verification of enterprises.


Article 29 The administrative department for urban and rural housing construction shall establish a green building evaluation system. Projects of one star and above using financial funds, as well as projects that declare national and provincial two-star and above evaluation marks, shall undergo green building evaluation.


Encourage construction units to actively declare green building signs.


Article 30 The whole process information system management based on information data shall be gradually implemented, including information management technologies such as building design, component production and construction organization based on building information model, so as to realize the whole process application management of design, production, transportation, assembly, operation and maintenance of building components and components.


Office buildings of state organs and other public buildings invested and constructed with state-owned funds should adopt building information model technology in the design stage and construction stage.


The construction unit of new industrial construction methods such as prefabricated buildings submits the building information model in the relevant technical identification stage.


Chapter four: Technology application and promotion and incentive measures


31st green building development adhere to local conditions, green low-carbon, recycling technology route, inherit, promote and innovate green building technology with Lingnan characteristics, adapt to subtropical climate.


Green buildings should be combined with terrain and geomorphology site design and building layout, and the building layout should be adapted to the climatic conditions and geographical environment of the site, and should be organized and utilized in the wind environment, light environment, thermal environment and sound environment of the site.


32nd encourage the implementation of higher than the national, provincial and municipal energy conservation standards, the development of ultra-low energy consumption, near-zero energy buildings. Encourage the use of renewable energy in civil buildings.


Office buildings of state organs and other public buildings with state-owned funds participating in the investment and construction should give priority to the construction of ultra-low energy consumption, near-zero energy consumption, zero energy consumption and production capacity buildings if conditions are available.


To promote the application of green building materials, large public buildings and office buildings of state organs, and other public buildings with state-owned funds to participate in the investment and construction should give priority to the use of green building materials. Encourage the use of construction waste production of building materials and the use of construction waste comprehensive utilization products.


Article 33 The exterior facades, structural layers, roofs or underground Spaces of green buildings shall be encouraged to carry out multi-level and multi-functional greening and beautification that integrates the garden ecosystem. Encourage the installation of elevated floors in buildings and expand public open space.


Article 34 Encourage farmers to build their own houses in accordance with the green building standards, and promote the use of green building materials.


Article 35 Financial institutions are encouraged to provide green financial services through various means such as green credit, green insurance and green bonds in accordance with relevant state regulations.


Encourage banking financial institutions to develop and promote energy efficiency loans, contract energy management income rights pledge loans and other credit products. Encourage insurance financial institutions to carry out green insurance business related to green building quality and green building performance.


Article 36 The municipal and district governments shall arrange funds to support the following green building development work:


(1) Preparation of special plans for green building development;


(2) Research and development of green building technologies and products;


(3) Construction and promotion of green building demonstration projects;


(D) green building standards formulation and green building related work funds;


(5) Construction and promotion of building demonstration projects built by prefabricated and other new building industrial construction methods;


(6) Construction and promotion of ultra-low energy consumption, near-zero energy consumption, zero energy consumption and capacity building demonstration projects.


Article 37 Projects constructed by prefabricated and other new building industrial construction methods shall be handled through parallel approval and green channel in the links of project initiation, planning permission and construction permit, so as to shorten the approval time of capital construction procedures.


38th use of housing provident fund loans to purchase two-star and above green buildings, prefabricated buildings and other new building industrial construction mode of construction as owner-occupied housing, the loan amount may not exceed the stipulated proportion of floating.


Chapter V Supplementary provisions


39th violation of the provisions of these measures, in accordance with the People's Republic of China Construction Law, Guangdong Green Building Regulations and other relevant provisions.


Article 40 These Measures shall come into force on January 14, 2024. Measures for the Administration of Green Buildings in Zhuhai Special Economic Zone (Zhuhai Municipal People's Government No. 119) shall be repealed at the same time.
