The Regulations on the Green Development of Buildings in Beijing (hereinafter referred to as the "Regulations") have been adopted by the Sixth meeting of the Standing Committee of the 16th Beijing Municipal People's Congress on November 24, 2023, and will come into force on March 1, 2024.


Legislative background


 The report of the Party's 20th National Congress pointed out that we should develop green and low-carbon industries; We will actively yet prudently promote peak carbon neutrality, and promote clean and low-carbon transformation in industry, construction, transportation and other sectors.


In the process of legislation, opinions were widely solicited through various means, and public opinion and wisdom were gathered to the maximum extent. In the drafting and review stage, the municipal People's Congress representatives in related fields formed six special groups to carry out research simultaneously, and formed a special research report; Contact the working mechanism of the Standing Committee of the District People's Congress to solicit opinions through the members of the meeting of the Chairmen of the Standing Committee of the Municipal People's Congress; Specifically communicating with relevant departments of The State Council for instructions and seeking support; We have used the work system of grassroots legislative contact points and legal construction consultants to solicit opinions from grassroots units, market entities, urban planning associations, lawyers associations, and experts and scholars in law and industry fields.


Legislative thinking


 Take the people as the center, pay attention to improving the comprehensive performance of building safety and durability, health and comfort, convenience and livable; Comprehensive policies are implemented around the legislative ideas of building life-cycle management, whole-field promotion and whole-industry support, paying attention to systematicness, correctly handling the relationship between long-term goals and short-term goals, seeking truth from facts, reasonably determining the current building standards and operation management requirements, reflecting gradual and gradual improvement; Innovation-driven, strengthen scientific and technological support, promote industry-university-research cooperation, and stimulate market vitality.


The regulations closely revolve around the legislative ideas, on the basis of widely gathering public opinion and listening to the needs of the grassroots, the targeted system design is mainly made from six aspects


Scope of application and basic requirements


These Regulations shall apply to the planning, construction, operation and maintenance, renovation and demolition activities of civil and industrial buildings within the administrative area of this Municipality, as well as the green development of related industries and their supervision and administration; The green development of municipal infrastructure shall be administered by reference to these Regulations. It is clear that the city's architectural green development adheres to the strategic positioning of the capital city, implements the overall urban plan of Beijing, takes the people as the center, and adheres to the basic requirements of the first good standard, innovation-driven, and regional coordination.


Management system and main responsibility


The municipal and district governments shall strengthen the organization, leadership and support for the green development of buildings, and the housing urban and rural construction departments shall be responsible for the overall planning, coordination, supervision and guidance of the green development of buildings. Construction, design, construction, supervision and other relevant participating units, building owners, trustees, respectively in the construction, operation, transformation and other links to bear the corresponding main responsibilities. The public should raise awareness and practice a simple, moderate, green and low-carbon production and life style.


Management requirements for the planning and construction phases


The relevant departments of the municipal people's government shall organize the preparation of the building green development plan, and the relevant contents shall be incorporated into the corresponding level of territorial space planning, and be clearly defined in the construction land planning conditions. New buildings shall comply with the corresponding standards and requirements for renewable energy applications. The municipal Department of Housing and urban and rural construction shall, together with relevant departments, formulate and publish the list of prohibited construction technologies, processes, materials and equipment, and conduct fair competition review according to law. The implementation of the green management system, in each link of the construction project to reflect the relevant building green development requirements. Promote the construction of green farm houses, guide the construction of livable housing in rural areas, and put forward encouraging measures that can enjoy policy support.


Responsibility requirements for operation, maintenance and transformation


The owner of the building shall bear the responsibility of green operation, maintenance and management to ensure the safe and stable operation of the building. This Municipality has established and improved the statistical system of energy and resource consumption of civil buildings and the graded management system of energy efficiency of public buildings; The green building identification system shall be implemented, and new large public buildings with government funds participating in the investment and construction shall apply for green building identification; Promote the energy-saving and green transformation of existing buildings in an orderly manner, and link up with urban renewal projects. On the basis of respecting the wishes of building owners, encourage the existing residential buildings to be carried out simultaneously with the renovation of professional pipelines such as water, electricity, gas and heat in buildings; Promote the green demolition of buildings, and implement the responsibility of construction waste disposal.


We will strengthen scientific and technological innovation and industrial support


The city establishes a construction technology innovation system and a collaborative innovation platform; Promote the coordinated development of intelligent construction and new building industrialization; Promote building materials green supply chain construction, promote the use of green building materials and construction waste recycling products; Strengthen information construction, explore the building number plate system, integrate the whole life cycle information, and promote the realization of data collection and information interconnection; We will promote the development of national green development demonstration zones such as sub-centers of cities, and improve the mechanism for coordinating work among the Beijing-Tianjin-Hebei region.


We will strengthen policy guidance and provide incentives


The Municipality takes measures to support the green development of buildings in the evaluation of engineering awards, personal use of housing provident fund loans and recognition awards; Improve the credit management system; Strengthen green building evaluation and implement healthy building evaluation system; Encourage cluster demonstration construction and improve agglomeration efficiency. The government will strengthen overall financial planning and encourage financial institutions to enhance the supply of green financial products.
