Recently, the Secretariat of the General Office of the Guangzhou Municipal People's Government issued the Regulations on the Management of Green Buildings and Building Energy Efficiency in Guangzhou. The Regulations require that public buildings with government investment and government investment shall be constructed in accordance with the energy saving standards of no less than ultra-low energy consumption buildings; The external wall area of ultra-low energy consumption buildings, near-zero energy consumption buildings and zero energy consumption buildings may not be included in the plot ratio calculation according to the proportion not exceeding 3% of the total capacity building area.

The Regulations on the Management of Green Buildings and Building Energy Efficiency of Guangzhou Municipality have been adopted at the 57th Executive Meeting of the 16th Session of the Municipal People's Government on December 21, 2023, and are hereby promulgated and shall come into force on March 1, 2024.

Regulations of Guangzhou City on the Administration of Green Buildings and building Energy Conservation


Article 1 In order to implement the concept of green development, promote the high-quality development of green buildings, strengthen the management of building energy conservation, improve the efficiency of building energy utilization, and help achieve carbon peak carbon neutrality, these Provisions are formulated in accordance with the relevant laws and regulations of the People's Republic of China on Energy Conservation, Regulations on Civil Building Energy Conservation, Regulations of Guangdong Province on Green Buildings and other relevant laws and regulations, and in light of the actual conditions of this Municipality.


Article 2 These Provisions shall apply to the planning, construction, operation and renovation of green buildings within the administrative area of this Municipality, building energy conservation and its supervision and administration.


The buildings mentioned in these Regulations refer to civil buildings.


Article 3 The development of green buildings and the implementation of building energy conservation shall follow the principles of saving resources, adapting to local conditions, being economical and reasonable, safe and reliable, and green and environmental protection.


Article 4 The municipal and district people's governments shall strengthen the leadership over the development of green buildings and building energy conservation work, incorporate it into the national economic and social development plan, coordinate the major issues concerning the development of green buildings and building energy conservation within their respective administrative areas, formulate work objectives, and improve the relevant working mechanisms for the assessment and evaluation of government energy conservation objectives. Provide financial support for green building development and building energy conservation.


Article 5 The municipal competent department of housing and urban and rural construction shall be responsible for organizing the implementation of these provisions, supervising, administering and guiding the city's green building and building energy conservation related activities, improving the public service system of green building and building energy conservation, and doing a good job in the publicity of laws, policies and scientific knowledge related to green building and building energy conservation.


The district housing urban and rural construction department shall be responsible for the supervision, administration and guidance of green building and building energy efficiency related activities within its administrative area, and may determine the green building and building energy efficiency management institutions at the same level according to the actual situation.


The municipal and district competent departments of housing and urban and rural construction may entrust their subordinate or designated administrative agencies to carry out specific management work related to green buildings and building energy conservation.


The departments of development and reform, finance, planning, natural resources, ecological environment, science and technology, industry and information technology, market supervision and administration shall, in accordance with these Provisions and the division of responsibilities prescribed by the people's governments at the corresponding levels, do a good job in the work related to green buildings and building energy conservation.


Article 6 Encourage the building industry association to play a role in service, self-discipline, coordination and supervision, carry out publicity and training, technology promotion, information exchange, consulting services, credit construction and other work of green building and building energy conservation, establish an industry self-discipline mechanism, and improve the overall level of the industry.


Encourage relevant industry associations to organize excellent building selection activities, green buildings and building energy efficiency into the relevant selection indicators.


Article 7 The municipal and district competent departments of housing and urban and rural construction shall, together with the departments of development and reform, planning and natural resources, organize the preparation of the municipal and district special plans for the development of green buildings according to the national economic and social development plans and the actual needs of urban construction and economic development, submit them to the people's governments at the same level for approval and make them public.


When planning and natural resources departments prepare detailed plans, they shall fully consider factors such as natural ventilation effect, green coverage rate and green building grade target in the overall layout, building orientation and green space setting.


Planning and natural resources departments shall, in accordance with the relevant requirements of the special planning for green building development, specify the requirements for prefabricated buildings in the planning conditions for construction land, the contract for the assignment of the right to use state-owned construction land or the decision on the allocation of state-owned land, and the planning license for construction projects.


Article 8 The district people's government shall determine a certain area within its jurisdiction, create and develop green ecological urban areas, specify its green building indicators and layout requirements, and realize the large-scale development of high-star green buildings above two stars. Promote the implementation of ultra-low energy buildings, near-zero energy buildings, zero-carbon buildings, green transformation of existing buildings, renewable energy building applications, prefabricated buildings, regional building energy efficiency improvement and other projects, to comprehensively improve the development of green buildings and building energy efficiency.


The specific regional scope of green ecological urban area is determined in the special plan for the development of green buildings in the district.


Article 9 In addition to the higher requirements of the special plan for the development of green buildings, new buildings shall meet the following requirements:


(A) meet the green building standards, of which large public buildings in accordance with the two-star or above green building standards for construction, office buildings of state organs, state-owned funds to participate in the construction of other public buildings in accordance with the one-star or above green building standards for construction;


(2) The construction of public buildings with government investment and mainly government investment shall be carried out in accordance with the energy conservation standards not lower than that of ultra-low energy consumption buildings;


(3) Install renewable energy systems in accordance with relevant national and provincial regulations;


(4) Where the management department has requirements for the construction method, it shall meet the relevant requirements of the state and the province and the city to promote the industrial construction technology of prefabricated buildings.


Encourage social investment projects to build high-star green buildings, ultra-low energy consumption buildings, near-zero energy consumption buildings and zero-carbon buildings.


Article 10 For fixed assets investment projects that need to be examined for energy conservation, the construction unit shall, in accordance with the relevant provisions, prepare and submit to the development and reform department a report on energy conservation for fixed assets investment projects. The energy conservation report shall include chapters related to green building and building energy conservation, clarify the building energy conservation standards implemented by the project, and determine the green building grade objectives. Government investment and construction projects based on government investment shall include green building and building energy efficiency costs in the investment estimate.


Article 11 For the construction projects that implement the star-rated green building standards, the construction unit or the owner unit may, after passing the examination of the construction drawing design of the construction project, submit an application to the corresponding competent department of housing and urban and rural construction in accordance with the relevant provisions of the province, and issue the design, construction and operation of the construction project in accordance with the national or local green building evaluation standards of the corresponding grade. After the project is completed and accepted for the record, the written commitment to declare and obtain the green building mark will be organized by the competent department of housing urban and rural construction to carry out the pre-evaluation of the star green building grade.


For a construction project implementing the prefabricated construction method, the construction unit or the owner unit may, at the stage of design and examination of the construction drawings of the construction project, submit an application to the municipal competent department of housing and urban and rural construction, and issue a written commitment for the design and construction of the construction project in accordance with the national or local evaluation standards for prefabricated buildings. The municipal competent department of housing urban and rural construction shall organize or entrust a third party to carry out pre-evaluation of the grade of prefabricated buildings, and conduct evaluation of prefabricated buildings in accordance with relevant provisions at the stage of completion acceptance of construction projects.


Encourage design, construction, consulting and other relevant units to jointly participate in the declaration of star-rated green buildings or prefabricated buildings grade pre-evaluation.


Article 12 This Municipality promotes the application of green building materials, and gradually increases the proportion of green building materials used in green buildings. Government-funded buildings should use green materials.


Market supervision and management, housing urban and rural construction, industry and information and other departments shall strengthen the supervision and management of the production, certification, acceptance and application of green building materials products in accordance with their respective responsibilities.


Article 13 Public buildings with central air conditioning systems are encouraged to use technical facilities such as efficient energy storage, cold storage, digital management and control platforms, and prefabricated high-efficiency refrigeration rooms to improve building energy efficiency.

The application of green building identification is proposed by the project construction unit, operation unit or owner unit, and relevant units such as design, construction and consulting are encouraged to participate in the application.


Article 15 Before a new green building is put into use, the materials handed over by the construction unit to the owner of the building, the owner of the right to use the building or the property service person shall include the grade and key technical indicators of the green building, technical measures for green building and building energy conservation, information on relevant facilities and equipment, and requirements for the operation and maintenance of the green building.


16th municipal housing urban and rural construction department shall improve the construction and management of the municipal building energy consumption monitoring platform, and realize information sharing with the municipal development and reform department.


Office buildings of state organs and large public buildings that are newly built, rebuilt, expanded or undergoing energy-saving transformation shall be designed and installed simultaneously with itemized metering devices for electricity consumption.


The owner of the building, the owner of the use right or the property service person entrusted by the owner as provided in the preceding paragraph shall ensure the normal operation of the sub-metering device for building electricity consumption, and transmit the relevant energy consumption data to the municipal building energy consumption monitoring platform in accordance with the requirements of the state, province and city.


Article 17 The municipal and district competent departments of housing and urban and rural construction shall, together with the development, reform and statistics departments at the same level, establish and improve the statistical system of building energy and resources consumption, organize investigation, statistics and analysis of the construction years, structural forms, energy use systems, energy consumption indicators and life cycles of existing buildings in their respective administrative areas, and formulate plans for energy conservation and renovation of existing buildings. Define the objectives, scope and requirements of energy-saving transformation, and organize implementation after approval by the people's governments at the corresponding levels.


Power supply, gas supply, water supply and other enterprises shall, before March 31 of each year, submit the classified statistical data of the previous year's building electricity, gas and water consumption to the competent department of housing and urban and rural construction in the district where they are located.


Article 18 Existing office buildings of state organs, public buildings with government investment and public buildings with government investment as the main part that exceed the energy consumption quota for buildings and have been audited for energy conservation and have the conditions for energy conservation renovation shall implement energy conservation renovation.


In addition to historical and cultural protection buildings, the implementation of energy-saving renovation of existing buildings, the overall performance of the renovated buildings or the thermal performance and energy efficiency indicators of the parts involved shall meet the mandatory standards for building energy conservation, and priority is given to low-cost transformation measures such as shading and improving ventilation.


When financial funds are used to transform urban renewal and old urban communities, green transformation (including energy saving transformation) should be implemented simultaneously, and a separate green transformation section should be set up in the transformation plan to clarify green transformation measures and improve the green and low-carbon level of the community.


Existing buildings are encouraged to install renewable energy utilization facilities on the premise of ensuring the safety of building structure, power supply, gas supply and water supply.


Article 19 The competent department of urban and rural housing construction shall, together with the financial department, formulate financial support policies for green buildings and building energy efficiency demonstration projects.


For the construction, purchase, operation of green buildings or the green transformation of existing buildings, the municipal competent department of housing and urban and rural construction shall jointly organize the implementation of the following incentive measures together with the municipal planning and natural resources department:


(A) due to the adoption of wall insulation, thermal insulation, moisture, shade, sound insulation and noise reduction and other green building technical measures to increase the building area is not included in the plot ratio accounting and real estate registration of the building area;


(2) For green buildings constructed by prefabricated method, the floor area of the part meeting the requirements of prefabricated construction may not be included in the plot ratio calculation according to the proportion not exceeding 3% of the total floor area;


(3) The external wall area of ultra-low energy consumption buildings, near-zero energy consumption buildings and zero energy consumption buildings may not be included in the plot ratio calculation according to the proportion not exceeding 3% of the total building area.


The same construction project shall not be repeatedly applied to the floor area ratio incentive measures stipulated in the preceding paragraph.


The municipal housing provident fund management agency can use the housing provident fund loan to buy the star green building owner-occupied housing loan amount in accordance with the proportion of not more than 20%.


Financial institutions and local financial organizations are encouraged to provide green financial services through green credit, green insurance, green bonds and other means in accordance with relevant state regulations, and provide support for star-rated green buildings, ultra-low energy consumption buildings, near-zero energy consumption buildings, zero-carbon buildings, and energy-saving renovation projects of existing buildings. Financial institutions will be encouraged to develop and promote credit products such as energy efficiency loans, loans pledged for the benefit of contract energy management, and carbon emission reduction loans.


Article 20 The development and reform department shall, together with the competent department of housing urban and rural construction, in accordance with the provisions of the state, province and this municipality, collect the public credit information of the units involved in the construction, survey, design, construction, supervision and operation of green buildings and building energy conservation related activities into the municipal public credit information platform, and carry out credit evaluation according to law, and take trustworthy incentive and punishment measures for breaking the trust. For green buildings and building energy efficiency projects that have been commended or awarded by the government or have been rated as demonstration projects, relevant units participating in green buildings and building energy efficiency activities can be listed as trustworthy incentive implementation objects.


Article 21 Where the relevant administrative departments and their staff violate these provisions and fail to perform their duties according to law, the competent authorities shall order them to make corrections, and the leading personnel who are responsible and the persons directly responsible shall be given sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law.


Article 22 These provisions shall come into force as of March 1, 2024. The Regulations of Guangzhou Municipality on the Administration of Green Buildings and Building Energy Efficiency promulgated by the Guangzhou Municipal People's Government on March 29, 2013 (Decree No. 92 of the Guangzhou Municipal People's Government) shall be repealed simultaneously.
