Shenzhen Green building identification management measures



Chapter I General provisions

Article 1 In order to regulate the management of green building signs in our city and promote the high-quality development of green buildings, these measures are formulated in accordance with the relevant provisions of the Green Building Regulations of Shenzhen Special Economic Zone, the Notice of the Ministry of Housing and Urban-Rural Development on the issuance of the Management Measures for green building Signs, and the Notice of the Guangdong Department of Housing and Urban-Rural Development on the declaration of green building signs in our Province.

Article 2 These Measures shall apply to the administration of green building marks within the administrative areas of this Municipality.

The term "green building sign" as mentioned in these Measures refers to the information sign indicating the star rating of a green building and containing performance indicators, including labels and certificates. Green building signs are unified by the Ministry of Housing and Urban-Rural Development, certificates are made by the granting department, and signs are made by the applicant units according to the production guide in accordance with different application scenarios.

Article 3 The green building identification of new civil buildings shall be carried out in accordance with the Green Building Evaluation Standard (GB/T 50378), and the green building identification of industrial buildings shall be carried out in accordance with the Green Industrial Building Evaluation Standard (GB/T 50878); The identification of green building marks for existing building renovation projects shall be carried out in accordance with the Evaluation Standards for Green Transformation of Existing Buildings (GB/T 51141).

Article 4 The scope of green building identification is civil buildings and industrial buildings that meet the green building star standard in this city.

The fifth green building identification stars are divided into one star, two stars and three stars from low to high.

Article 6 The municipal competent department of housing construction shall be responsible for formulating and improving the municipal green building marking management system; Identify one-star green buildings and award the logo, and promote the identification of two-star and three-star green buildings in accordance with the relevant regulations of the State and Guangdong Province; Establish Shenzhen Green building identification management information system (hereinafter referred to as the information system), and establish a sharing mechanism with Guangdong Green Building Information platform.

Article 7 New state organ office building projects, financial funds to participate in the investment and construction of large public building projects, project construction units, operating units or owner units (hereinafter referred to as the reporting unit) shall declare the corresponding star green building logo within the prescribed time. Other construction project declaration units are encouraged to actively declare green building marks.

The construction projects declaring the one-star and two-star green building marks shall be declared within 2 years after the completion acceptance record, and the construction projects declaring the three-star green building marks shall be declared within 3 years after the completion acceptance record.

Article 8 The green building marks of different stars shall be applied for by the declaring units in accordance with the relevant regulations of the State, Guangdong Province and this municipality.

Article 9 The funds required by the municipal competent department of housing construction to carry out the identification of green building marks shall be included in the annual budget of the department.

The second chapter one-star green building identification procedures

Article 10 The identification of green building marks shall follow the principles of science, openness, fairness and justice, and shall be subject to declaration, review, publicity, publication and other links, including formal review and expert review.

Article 11 After the design of the construction drawings of a construction project is completed, the construction unit may organize the pre-evaluation of green buildings.

Article 12 The project applying for green building mark shall meet the following conditions:

(1) Meet the corresponding standard requirements in Article 3 of these Measures;

(2) has passed the construction project completion acceptance and completed the record;

(3) Comply with national and local green building laws and regulations.

Article 13 The reporting unit shall fill in the basic information and main technical indicators of the project in the information system, submit the application materials online, and be responsible for the authenticity, accuracy and completeness of the application materials. The application materials shall include the following contents:

(A) green building identification declaration;

(2) Project approval and other relevant documents;

(C) Green building grade compliance assessment report issued by qualified third-party assessment institutions before the special acceptance of green buildings;

(4) Introduction of the applicant, qualification certificate, unified social credit code certificate, etc.;

(5) Drawings, reports, calculations, pictures, videos and other technical documents related to identification;

(6) A commitment letter to report the operating data of major green performance indicators annually.

Article 14 The municipal housing construction competent department shall conduct a formal review of the project declaring the green building mark, and feedback the review results within 5 working days. The main contents of the formal review are as follows:

(1) whether the reporting units and projects meet the requirements for reporting;

(2) Whether the application materials are complete, complete and valid.

If the declaration materials are not complete, the reporting unit shall be informed of the materials to be supplemented at one time, and the acceptance date shall be recalculated from the date on which the declaration materials are supplemented.

15th through the formal review of the project, the municipal housing construction department shall organize experts review, in accordance with the corresponding green building evaluation standards through data verification and on-site verification, review the green building performance of the project, determine the green building grade.

16th through the expert review of the project, the municipal housing construction department should be published on the portal website. The publicity content includes the project location, type, name, declaration unit, green building star, construction area and key technical indicators. The publicity period shall not be less than 7 working days. Opinions raised within the publicity period must be verified and objections handled.

17th for the public no objection to the project, the municipal housing construction department issued an announcement, and awarded a certificate.

Chapter III Supervision and administration

Article 18 The municipal and district housing construction competent department shall strengthen the management of green building marks, and the municipal housing construction competent department shall publish the relevant information on the portal website for the projects that do not declare green building marks in accordance with the requirements of article 7 of these measures.

19th district housing construction authorities shall regularly extract a certain proportion of buildings to carry out green building post-assessment work, in accordance with the provisions of article 7 of these measures should be declared green building mark but not within the specified time to declare and obtain green building mark projects, focus on green building post-assessment work. After evaluation that no longer meet the corresponding green building grade requirements of the project, the district housing construction authorities should be the project construction units, operating units or owners of rectification opinions and published to the public.

The municipal competent department of housing construction shall guide and supervise the post-evaluation work.

Article 20 Construction units, operating units or building owners who have obtained green building identification projects shall strengthen the operation management of green buildings, strengthen the comparison of operation indicators with the declaration of green building star indicators, and report major indicators such as building energy consumption, building water consumption, air quality and sound environment in annual operation to the information system according to relevant requirements.

The owner of a new state organ office building project or a large public building project in which financial funds participate in the investment and construction shall express a green building sign in a prominent position in the public space of the building or community and accept social supervision.

Other green building owners are encouraged to display the green building sign in a prominent position.

Article 21 The owner of the building, the owner of the right to use the building, the relevant exclusive units or the entrusted property service enterprises or professional service units shall regularly adjust, evaluate, maintain and maintain the facilities and equipment related to green buildings to ensure the normal operation of energy saving, water saving, metering and other facilities and equipment; Failure to adjust, evaluate, maintain and maintain facilities and equipment such as energy saving, water saving and measurement of buildings shall be dealt with by the municipal and district competent department of housing construction according to law.

22nd municipal, district housing construction authorities found that the green building mark project has any of the following problems, should put forward a deadline for rectification requirements, rectification period is not more than 2 years:

(1) The project is lower than the green building star rating;

(b) the main performance of the project is lower than the indicators of the green building identification certificate;

(3) Using green building signs for false publicity;

(4) failing to truthfully report major index data for more than two consecutive years.

Article 23 If the municipal or district housing construction competent department finds any of the following problems in the project that has obtained the green building mark, the municipal housing construction competent department shall request the marking awarding department to revoke its green building mark, recover the label and certificate:

(1) Rectification is not completed within the rectification period;

(2) Forging technical materials and data to obtain green building marks;

(3) A major security accident occurs.

Chapter IV Supplementary Provisions

Article 24 The identification of two-star and three-star green building marks shall be implemented in accordance with the relevant requirements of the State and Guangdong Province.

The superior housing construction competent department entrusts the municipal housing construction competent department to declare the green building project for preliminary examination or identification, and the reporting unit shall fill in the basic information and main technical indicators of the project in the information system.

Article 25 These Measures shall come into force on June 1, 2024 and be valid for 5 years.
